HomeMy Public PortalAbout09343 O R D I N A N C E NO. 9343 AN ORDINANCE, appropriating Forty-two Thousand Dollars ($42,000.00) from the Reserve for Real Property Purchase, Improvements and Alterations Fund for the purchase of certain real property in the City of St. Louis, Missouri to be used as a pump station site for the Lemay Overflow Regulation System; and authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to purchase from the owners thereof the aforementioned real property. WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of Forty-two Thousand Dollars ($42,000.00) is hereby appropriated from the Reserve for Real Property Purchase, Improvements and Alterations Fund for the purchase of certain real property in the City of St. Louis, Missouri to be used as a pump station site for the Lemay Overflow Regulation System. Section Two. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to purchase from the owners thereof the following real property in the City of St. Louis, Missouri to be used as a pump station site for the Lemay Overflow Regulation System, at a price not to exceed Forty-two Thousand Dollars ($42,000.00), said property to be free from all liens and encumbrances, and more particularly described as follows: Part of Lot 4 of PETER KENRICK'S SUBDIVISION and in Block 3221 of the City of St. Louis, beginning at a point in the Southwesterly line of Marceau Street where same is intersected by the Southeasterly line of said Lot 4; thence 2 Southwesterly along the Southeasterly line of said Lot 4, 214 feet 1/2 inch to the Northeasterly line of Right-of-Way of River des Peres Drainage Works, as established by Ordinance No. 32986; thence Northwesterly along the Northesterly line of said Right-of-Way 36 feet 8 inches to a point; thence Northeasterly 195 feet 1-1/2 inches to the Southwesterly line of Marceau Street; thence Southeasterly along said Southwesterly line of Marceau Street 32 feet to place of beginning; according to Survey executed by E.R. Kinsey and Sons, Surveyors and Engineers on February 7, 1951, together with all improvements thereon, known as and numbered as 616 Marceau Street. Part of Lot No. 4 of PETER RICHARD KENRICK'S SUBDIVISION, and in Block No. 3221 of the City of St. Louis, beginning at a point in the Southwest line of Marceau Street, distant 32 feet Northwest of the Northeast corner of said Lot No. 4; thence Southwest and parallel with the Southeast line of said Lot No. 4 a distance of 95 feet to a point; thence Northwest and parallel with the Southwest line of Marceau Street 41 feet 7 inches to the Southeast line of an alley; thence Northeast along said alley 95 feet 7 inches to the Southwest line of Marceau Street; thence Southeast along said Southwest line of Marceau Street 33 feet 6-1/2 inches to the point of beginning according to survey by E.R. Kinsey and Son on July 28, 1950, together with all improvements thereon, known as and numbered 618 W. Marceau. Section Three. Upon the execution and delivery to them by said owners of a General Warranty Deed in proper form, being free from liens and encumbrances, conveying title to said land to The Metropolitan St. Louis Sewer District, the Executive Director and Secretary-Treasurer are hereby authorized to pay to said owners for said real property and improvements thereon a total sum not to exceed Forty-two Thousand Dollars ($42,000.00). Section Four. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. The foregoing Ordinance was adopted September 14, 1994.
