Call to Order: Commissioner Nolan called the meeting to order at 7:00 p.m. Present: Planning Commissioners, Charles Nolan, Robin Reid, Victoria Reid, Michele Litts, Beth Nielsen and Mary Verbick. Absent: Jim Simons Also Present: Associate Planner Dusty Finke, and Planning Assistant Debra Peterson -Dufresne 2. Public Comments on Items not on the Agenda: No public comments. 3. Update from City Council Proceedings: Liz Weir updated the Commission with the following: • The Council passed the Rural Public/Semi Public zoning ordinance which removes churches and public buildings as conditional uses from the Rural Residential zoning districts and places them in a Rural Public/Semi Public district. The new ordinance places intensity -of -use -restrictions on existing uses within the Rural Residential zoning district as follows: institutional buildings may have a footprint of 35,000 square feet and a total floor space of 40,000 square feet; parking is limited to 300 stalls; the maximum seating of an assembly chamber or sanctuary is 500, and the maximum number of people allowed in the building is twice the size of that chamber; • Approved the rezoning of three institutional properties to the new district, Medina City Hall, First Apostolic Lutheran Church and Woodridge Church; directed staff to draft an ordinance to lift the moratorium on the new Rural Public/Semi Public zoning district; • Directed staff to draft an ordinance to lift the moratorium on the new Rural Public/Semi Public zoning district; • Heard an annual report from Hamel Fire Depaituient Chief Brandon Guest. The department added six new fire fighters and now has 26 volunteer fire fighters. Calls increased from the previous year with average response time within Medina 6.38 minutes. The Hamel and Loretto Fire Departments continue to make progress towards an eventual merger; • Accepted the resignation of the Parks Commissioner Brian Kingsley and appointed William Waytas to replace him; • Approved three resolutions for Wrangler's Restaurant in Uptown Hamel to move forward with all the conditions of the PC; 1 Medina Planning Commission Draft July 14, 2009 Meeting Minutes • Amended Medina's public nuisance ordinance to include long, unmowed grass and weeds on properties that are not being cared for; • Gratefully accepted a Centerpoint Energy Grant for $2,500 for police to purchase a Search and Find Emergency Responder devise; • Directed staff to alter the planned sequence for ordinance rewrites that will support the Comprehensive Plan and accelerate the General Business ordinance to the September Planning Commission meeting. • Learned that it will cost a minimum of $10,000 to bring City Hall's trash enclosure into compliance with code by building an enclosure to contain it. 4. Planning Department Report: Finke updated the Commission on future projects and ordinances. 5. Approval of June 9, 2009 Planning Commission Minutes: Motion by. R. Reid, seconded by Litts to approve the June 9, 2009 minutes with recommended changes. Motion carried unanimously. (Absent: Simons) 6. Public Hearing - Hamel Legion Field House — City of Medina (PID 12-118-23-44- 0017) — Conditional Use Permit for the construction of two buildings for Concessions and Storage. Peterson -Dufresne presented the application to the Commission. She specifically reviewed location, site area details, accessibility, relocation of trees, emergency access, plantings, LID and Sustainable Design Initiatives, and exterior building materials. Nolan inquired what would be stored in the accessory structure. McIlwan of Hagen, Christensen & Mcllwan Architects summarized the process as to how the Task Force arose at the design. He explained the concession building included restrooms and storage on the main level and above. The storage building is intended for field maintenance equipment. The storage building would have attic joists for a future ceiling which could provide storage above. Constructing two separate buildings rather than one allows for less expensive construction, and it creates a plaza space. The overhangs on the roof of the concessions building will provide coverage from rain and sun. The arbor between the two buildings will provide shade and will tie the two buildings together aesthetically. R. Reid said the first thing the City had to do after constructing the Community Building was to put gutters on. She asked if either of the buildings proposed would need gutters. Mcllwan said water would sheet off the roof far enough away from the building and shouldn't cause an issue with maintenance. He said downspouts are often damaged in high traffic areas and described the ultimate plan to deviate stormwater run-off to the pond and then to irrigate. Weir stated she would strongly recommend discussing alternatives with the Fire Marshal to reduce the hardcover on -site. 2 Medina Planning Commission Draft July 14, 2009 Meeting Minutes Public Hearing was opened at 7:38 p.m. Nolan stated even though the City is the applicant in this case, it is important the Commission review the application with the same care as any other application, and similar conditions be applied. Public Hearing was closed at 7:40 p.m. R. Reid said perennial plantings were preferable. V. Reid said native plantings should be planted so they are easier to maintain and then watering wouldn't be as much of an issue. The Commission directed staff to discuss the width of the emergency drive with the fire marshal to reduce on -site hardcover. Mcllwan stated planter pots were originally proposed since in -ground plantings tend to be trampled and never last in this type of environment. The consensus of the Commission was to recommend the exterior building materials and colors be approved as designed on the plan by Hagen, Christensen & Mcllwan Architects. R. Reid recommended approval subject to native perennial plantings and reducing the width of the emergency drive if possible, and removing the first sentence of condition 3. Motion by R. Reid, Seconded by Litts to approve the Conditional Use Permit with recommendations and conditions specified. (Absent: Simons) 7. Public Hearing - Ordinance Amendment to Chapter 8, Section 826 of the City Code - Pertaining to the Creation of new zoning regulations for future residential development within the area of the City to be served by municipal sewer and water infrastructure. Finke presented the ordinance amendment to the Commission. He explained the need for zoning regulations for future residential developments within the area of City municipal sewer and water infrastructure. He informed the Commission that buffering between districts was raised as a concern at the open house held in late June. Finke explained exterior building materials in the district. He said at least 20 percent of a building would be required to have accent materials for facades facing a street. Multiple family homes, excluding townhomes, would be required to have 50 percent noncombustible materials. The Commission raised concern with garage doors facing a street and the possibility of providing a credit for garages having habitable space above them. Building modulation/articulation was also discussed and the Commission felt a multiple family building would need to have variations at a minimum of every 60 feet when facing a street. Medina Planning Commission Draft July 14, 2009 Meeting Minutes Finke informed the Commission the ordinance required townhomes to have a minimum two car attached garage. Multiple family construction was recommended to require one enclosed parking space in the building. Finke reviewed the design/development standards for the R-3, R-4, and R-5 districts such as: • Buffer yards between properties • Landscaping requirements • Parking lot landscaping R. Reid asked how common the regulation was requiring side loaded garages rather than garage doors facing the street. Finke explained it was not that common of a requirement. The Commission asked why the building height was recommended higher. Finke explained building height is due to fire safety (eave height) and aesthetics. Further explaining how building height is measured at midpoint of roof and the current code is 30 feet for a residential home. Staff recommended to increase the height based on comments received from builders that the City is too restrictive. Nolan raised concern with properties having more than one zoning district. He asked at what level would each lot get rezoned and asked if it was the developer making the request at the time of development. Finke explained the City would decide which district the lot would be zoned and would initiate the next step for each lot. Nolan asked for clarification on how existing residential districts would be handled if their zoning changed. Finke explained if a lot was created prior to the new ordinance the property could follow the old standards. If a house burnt down it could be rebuilt under the old standards. Finke explained that existing homes are currently zoned appropriately. He said the properties on the map not in color would stay under their current zoning district. V. Reid asked for clarification of buffer yards. Finke explained buffering with the use of setbacks and landscaping. V. Reid raised concern with how to buffer a multifamily building since some of the buildings are taller and would not be able to be screened with landscaping. Finke clarified the recommended ordinance and said it may be a good idea to look at building height as a trigger for buffering. V. Reid asked why attached garages in the multifamily districts were recommended, and if it was only for aesthetic reasons. She said detached garages can have more of an urban design. Nielsen asked about bonus rooms above a garage and how a credit would apply. Finke clarified. Nielsen further asked for clarification on daycare uses. Finke reviewed the chart within the staff report. R. Reid asked if the tree preservation and wetland ordinances applied city wide. Finke said the wetland ordinance applies in the instance of the proposed residential ordinances. Public Hearing was opened at 8:28 p.m. 4 Medina Planning Commission Draft July 14, 2009 Meeting Minutes Bob Kroll of 315 Calamus Circle asked for clarification on the density proposed for the property to the west of Wild Meadows North. He said there are no real trees in the area and had concerns with future development and wanted to see greater setbacks/buffering implemented. He asked when the property to the west of Wild Meadows North Addition develops something adequate is established between them. Nolan explained the process and how the City was mandated to have a minimum density. He also explained the City selected where the density should be established. He explained the Commission is concerned with the regulations pertaining to buffering rather than looking at a specific development to determine the regulations. Nolan explained the next step and that when a development comes to the City it would be at that time the City would look at a specific property and apply the standards. Kroll clarified that adequate buffering was the main concern of his neighbors. Paul Robinson of RGN Development had comments related to the R-1 an R-2 districts: Buffers: • Requiring a two year guarantee for landscaping seemed fair, but more than that it makes it difficult since the builder is typically no longer involved. • Concern with maximum 60 percent impervious coverage. • He said building height of 35 feet is standard and it seems to be what people are wanting out there. • He suggested garage fronts should only pertain to R-3 districts. • He suggested R-2 districts constructed with side load garages have a lesser front yard setback and front loads would trigger a greater setback. He thought the City should allow flexibility to front yard setbacks for side loading garages. • He raised concern with the fact that there are not a lot of builders out there to review the recommended ordinance, since there is not a lot of building activity. Once activity picks up again, contractors may raise concern with the ordinance. Overall he felt the ordinance was fair. Finke explained the intention of credits and that they would be located within the landscape ordinance. He clarified the front yard setback was recently reduced to 25 feet. He felt the side load garages with reduced setbacks was an interesting concept and asked the Commission to further discuss. His main concern was providing sufficient space for a vehicle to park in a driveway. Nielsen asked if contractors continue to be responsible for tree replacement and after 2-3 years what happens if the trees die. Finke explained the responsibility continues to be held by the contractor. Robinson clarified the issues of tree care. Mark Lamberty of 4250 Arrowhead Drive raised concern with medium density recommended near his home. He informed the Commission that he spoke with Finke during the open house and asked how the City designated density. Nolan explained a group was formed by the City to determine where certain densities should be located. The process took over 2 years. He 5 Medina Planning Commission Draft July 14, 2009 Meeting Minutes explained it was a culmination of factors which determined zoning on a lot. Lamberty raised concern with the inability to develop his land without additional properties. He explained when the City previously talked about the districts he wasn't aware of the potential requirements and the impacts they would have on developing his lot. Robinson said he had a vacant lot that he personally planted trees on and asked if he would have to replace a percentage of them if he removed them for development. Finke explained if an owner can prove they planted trees on their lot, they would not be required to replace. Luann Sawochka of 4268 Arrowhead Drive encouraged the Commission to allow credits for "green" practices. Nolan asked if staff could provide a visual of what an R-1 district would look like. Finke explained at the open house people wanted less density and buffer yards. He further explained the objectives of the comprehensive plan which is to get a diversity of densities; Examples of densities: Wild Meadows North is one unit per acre or larger; Wild Meadows South is approximately two units per acre; Foxberry is 1.5-1.6 units per net acre; Cherry Hill is approximately 2.6 units per net acre; Highlands is approximately 3.1 units per acre which are twin homes; Gramercy is 10 units per acre; 705 Hamel Road (3 unit building) was approved for 7.5 units per acre, but is not constructed and Argent Park exceeds 20 units per acre. Litts asked if during the Comprehensive Plan process the Commission discussed transition of zoning. R. Reid asked if the City would rezone specific properties. Finke explained that traditionally properties would be in a holding district such as RR-UR until they are ready to be developed or are close to being able to be developed with City services. He further explained the staging plan of the MUSA. Nolan asked if density should be divided down further for lower density districts. Finke explained it's common to have a variety of single family districts with different lot size standards. V. Reid asked if the ordinance would allow flexibility. Nolan asked if the concern was not meeting the density standards. He would like flexibility since the City has a lot of wetlands. Robinson asked what is taken out to determine net density. Finke said wetland buffers/right-of- way for collector and arterial roadways, conservation easements, and parks. Finke clarified that the Commission's consensus was to take out maximum lot size and use the comprehensive plan as a guide. V. Reid suggested to only apply standards to each development and not the City overall. Nolan summarized the Commissions comments on roof height. Finke explained the issues staff had experienced within the Bridgewater development with grades and comments from contractors. 6 Medina Planning Commission Draft July 14, 2009 Meeting Minutes Weir asked if open space would be gained by adding height to 35 feet. Finke said he didn't think an increase in height would trigger additional open space. Building height was heavily debated and R. Reid recommended the Commissions comments be provided to the Council and to let them make the decision. Garage facades were discussed by the Commission. R. Reid felt houses with three garage doors facing the street look bad. Terry Prnstinr of Prnstinr Design prefers turned garages from a design perspective, which is better for empty nesters but more expensive. The Commission asked staff to figure out ways to provide incentives to turn garages such as reduced setbacks. Robinson clarified a minimum of three car garages are needed on homes for storage of boats, trailers, and RV's. He pointed out if sufficient enclosed space is not provided, the storage would be visible outside. The Commission discussed giving credit for habitable space above garages. Bill Coffman commented that bonus rooms above garages are really selling well, and often dormers are installed for aesthetics. Nolan raised concern with an incentive for a bonus room above a garage. The consensus of the Commission was to not give credit. Finke explained conditional uses have a separate set of conditions under the district. Weir asked if the City will meet residential densities mandated by the metropolitan council. Finke said the ordinance will not hurt the density standards. Nolan asked about daycare requirements. Finke explained he took the Daycare standards from the state standards. Commission concluded to establish a maximum floor area for R-1 and R-2, and not for balance of districts. Impervious surface — Finke explained if someone installed a pervious driveway it wouldn't count towards the maximum impervious surface percentage. He suggested if an applicant integrated stormwater treatment, rain gardens or other LID practices on an individual lot, credits should be given. Nolan asked if it would be appropriate to attach something to each of the districts or have separate low impact design standards. Finke felt it would be more appropriate within each zoning district. A strong consensus by the Commission to provide credits for LID efforts. Prnstinr suggested Frank Svoboda as a great resource for integrated stormwater treatment. Finke explained the City can give other incentives such as reduced fees. 7 Medina Planning Commission Draft July 14, 2009 Meeting Minutes The Commission reviewed density bonuses and Weir suggested requiring two underground parking spaces for multi -family rather than one space. Finke said he would add the requirement. The Commission requested a better definition for "common open space". The Commission requested staff to better define or clarify landscape buffers and potential credits. Finke explained buffer yards were not included in the R-3 zoning district, but a requirement could be added. The Commission agreed to add requirements to R-3 district. The Commission also agreed to provide a credit for shared driveways on twin homes. Nolan suggested all commercial and R-3 zoned properties go through a Site Plan Review process for approval. V. Reid asked if all commercial buildings have to go through a Site Plan Review. Nolan explained it is a requirement. Finke explained the recommended ordinance exceeds other community's regulations as it relates to abutting other single family properties. Nolan raised concern with the sensitivity of single family properties abutting multifamily developments. Finke said the overall regulations are of higher standards, which should satisfy his concern. Summary: 1. A 50 foot building modulation for multi -family residential and detached garages shall not be allowed. 2. Removal of maximum acreage for the R-1 and R-2 zoning districts. 3. Building height shall be determined by City Council. 4. Site plan review shall be required for zoning districts R-3 through R-5. 5. Trees may be transferred to homeowners associations with a maximum of 4 years of responsibility total for the lot. 6. Credits shall be given for low impact development. 7. Reduced setback for side load garages. 8. Garage fronts shall have recessed areas if front load. Public Hearing closed at 10:38 p.m. Motion by Nielsen, seconded by R. Reid, seconded by Nielsen to adjourn at 10:30 p.m. Motion carried unanimously (Absent: Simons). 8 Agenda Item: MEMORANDUM TO: Planning Commission FROM: Debra Peterson -Dufresne, Planning Assistant, through Dusty Finke, City Planner DATE: August 7, 2009 MEETING: August 11, 2009, Planning Commission SUBJ: Public Hearing - Woodridge Church at 1500 County Road 24 - Conditional Use Permit Amendment & Interim Use Permit Review Deadline Complete Application Received: November 10, 2008 120-day Review Deadline: March 9, 2009 Extension Deadline: September 8, 2009 Background The applicant, Woodridge Church, requests approval of an amended Conditional Use Permit to construct a 14,097 square foot addition to the existing church. The applicant also requests an Interim Use Permit to formalize the continued use of the existing single family home at 1432 County Road 24 that was purchased by the church in 1993 under a life estate. The subject property is zoned Rural Public/Semi Public (RPS) and guided Rural Residential in the 2000-2020 Comprehensive Plan. The property was one of three properties recently rezoned from Rural Residential to this new zoning district. This RPS district has regulations for religious institutions which are different than the Rural Residential district such as building size, the number of parking spaces, and impervious coverage. All surrounding properties are zoned RR. The application exceeds the maximum building square footage in the RPS district by 2,166 square feet. History - Resolutions The referenced resolutions below will be incorporated into one resolution under this CUP application if this application is approved. In 1995, a CUP was approved to construct Woodridge Church (Resolution 95-29). A11 conditions within the resolutions have either been satisfied or have been incorporated into the recommended conditions. In 1998, a CUP amendment was approved to expand the church and parking lot (Resolution 98- 41). All conditions within the resolutions have either been satisfied or have been incorporated into the recommended conditions. In 1999, a CUP amendment was approved to allow the Montessori School of Wayzata Bay (Resolution 99-66) to operate a preschool/kindergarten program. All conditions within the resolutions have either been satisfied or have been incorporated into the recommended conditions. Project Summary The applicant has indicated that the church is currently undersized in Fellowship, Christian Education and Administration space based on their current worship center seating capacity and goals for future growth. The addition is proposed on the northeast side of the existing church and is two levels. The main level is 7,571 square feet containing a check -in area, coffee bar, break room, prayer room, community room, classrooms, offices, infant rooms, restrooms, mechanical rooms, and storage rooms. The lower level is proposed to be 6,526 square feet containing an office/game room, classrooms, kitchenette with a hang-out area, student meeting area, mechanical rooms, storage rooms, and restrooms. The project will also include the relocation and update of the existing septic system, sprinkling of the building and an improved entry on the north side of the building. New landscaping will also be incorporated around the North entry plaza with a concrete patio. Interim Use Permit Staff recommended the applicant request approval of an Interim Use Permit (IUP) as part of their application. The IUP relates to the existing single family home at 1432 County Road 24 which was purchased by the church in 1993 under a life estate. The IUP would allow the continuation of the home which would expire when the current resident no longer occupies the home. Because the house and garage are an Interim Use, staff does not recommend counting the floor. area of the structures against the maximum allowed on the property. If the applicant wishes for the opportunity to utilize the structures after the expiration of the Interim Use, staff would recommend including this floor area. The applicant proposes 290 to remain as part of the project. Spaces will be removed at the front entrance for fire truck accessibility and near the north entrance. The applicant suggests a total of 232 parking spaces are required but staff questions this calculation. Based on the occupancy of the various spaces in the structure, parking needs may be higher. The RPS regulations limit the maximum number of persons on -site at one time to twice the sanctuary capacity (932 people). Parking standards require 1 stall per 3 seats in the sanctuary and 1 stall per 4 seats in classroom areas. Staff recommends a condition that the church monitor the parking and make programmatic changes if the proposed parking is not sufficient for activities (more services, etc.) Wetlands As part of the application process the applicant has submitted a wetland delineation report and was reviewed by the City's wetland specialist. It was required of the applicant to install a 20 Woodridge Church CUP Amendment 3 August 11, 2009 Planning Commission foot buffer area down gradient from any work. The applicant incorporated these requirements into their plan and staff placed a condition of approval that the applicant records an easement over the wetland buffer area. Septic System The applicant proposes a mound system north of the parking lot. The mound system as proposed does not meet setback requirements from a wetland of 75 feet. Meeting the setback is a condition of approval, along with identifying an alternate septic site. LID Practices The applicant proposes a treatment cell on the east side of the parking lot to help stormwater run- off, which serves as a pretreatment system. Sediment Ponds Under the original approval in 1995, a condition was placed on the approval that the sediment pond depth at the outlet be required to be monitored annually per approval of the original CUP. When the depth decreases below four feet, the pond is required to be dredged out. A report is required to be submitted to the City. Elevations were shot of the sediment pond by Gronberg & Associates and a letter was sent to the City dated July 22, 2009 requesting direction. Public Works reviewed the report and recommends the pond be returned to its original design by rebuilding the berm to a 991.0 elevation for the entire length and return the corners of the second cell to their original design. Cleaning of all sediment at the point of inlets and outlets of the pond is also required. The Gronberg & Assoc. letter is attached. Public works has not yet sent a letter to Gronberg & Assoc. providing direction but will send letter. The annual inspection will be continued as a condition of approval. Landscaping Landscaping is primarily proposed to be located on the north side of the building, east of the proposed patio. The planting schedule includes a variety of perennial shrubs which will provide varying colors. Under previous resolutions trees are required to be planted within the parking lot islands. After inspecting the site, trees within the landscape islands are scarce. Staff recommends each parking Woodridge Church CUP Amendment 4 August 11, 2009 Planning Commission lot island have trees installed to break up the appearance of the parking lot spaces and improve the aesthetics. Screening from Neighboring Property Staff recommends additional spruce or pine trees be installed along the west side of the parking lot and at the curve of the driveway exiting the parking lot to screen headlight reflection. The addition is within the existing developed area, so staff is not recommending additional screening at this time. Lighting Two light poles are proposed to be repositioned within their existing islands. Recessed lighting is proposed under the canopy at the north entrance. A photometric plan was not submitted as part of this application, but a condition has been placed on the approval that a photometric plan of the entire parking lot be submitted, meeting requirements prior to the issuance of a building permit. Staff has received complaints related to lighting and want verification that what was originally installed meets the City's requirements for this zoning district. Additional, staff recommends a condition that active lighting controls be utilize so that parking lot lights can be controlled based on activities on the site. Exterior Building Materials & Height The exterior of the addition is proposed to match the existing materials and colors. Staff is satisfied with the proposed materials if the application is approved. Materials include metal roof and flashing, two styles of brick, EIFS siding, and rock face block. The applicant has submitted a sample board that will be presented at the meeting. yE� Woodridge Church uur Amendment 5 August 11, 2009 Planning Commission Tree Preservation The property has a minimum of 232 significant trees. The City Code allows removal of up to 10% of significant trees on -site for activities "other than initial site development". The applicant proposes to remove 8 significant trees, which is a 3.049% removal. No significant trees are proposed or required to be planted. RURAL PUBLIC/SEMI-PUBLIC ZONING REGULATIONS The regulations pertaining to the use and district have been included below: 826.68 Subd. 2 (Building Design) (a) Maximum Building Size: The combined floor area of all structures shall not exceed 40,000 square feet. Additionally, the footprint area of all structures on a parcel shall not exceed 35,000 square feet. The proposed building exceeds the maximum square footage allowed. 826.68 Subd. 4. (Landscaping and Screening) The RPS ordinance includes requirements for landscaping and screening. As stated above, there are many existing significant trees on the property. Staff does not recommend additional landscaping than is provided. The RPS ordinance includes requirements for landscaping areas within parking lots. Since the applicant is not proposing an expansion of the parking lot, staff does not recommend a condition related to re -constructing the parking lot to add additional landscaping areas. However, as mentioned above, staff does recommend replacement of trees in the parking lot islands, with proper species selection and maintenance. 826.68 Subd. 7. (SUPPLEMENTAL REQUIREMENTS FOR SPECIFIC USES WITHIN THE RPS ZONING DISTRICT) In addition to the general standards specified for conditional uses in section 825.39 of the City Code and other requirements of this ordinance, the following uses shall not be permitted unless the city council determines that all 'of the specific standards contained in this subdivision will be met: (i) the minimum lot size shall be increased to 10 acres. Additionally, the lot must contain at least five acres of contiguous soils suitable for a standard sewage disposal system as defined in section 720 Individual Sewage Treatment Systems and in section 826.25 subd. 2. The lot must contain a primary and secondary site for an sewage disposal system; The applicant will be required to provide new septic locations to meet wetland setback requirements as a condition of approval. (ii) the minimum lot width shall be increased to 500 feet; The lot is 674 feet in width. (iii) shall abut an arterial roadway or abut a collector roadway no more than 1,500 feet from an intersection with an arterial roadway; The property abuts a minor arterial roadway. (iv) no exterior bells or loudspeakers; This has been placed as a condition of approval. Woodridge Church CUP Amendment 6 August 11, 2009 Planning Commission (v) direct views of parking lots and structures from surrounding residential properties shall be effectively screened. This may include the requirements for additional plantings than required in the landscaping requirements above; (vi) sanctuary seating capacity shall not exceed 500 persons; The existing sanctuary has 466 seats which falls below the maximum 500. (vii) the number of persons on -site at any given time shall not exceed two times the capacity of the sanctuary, with the exception of larger events no more than four times per year. The city may place further limitations on the number of persons on -site based on the number of parking stalls provided; A condition of approval has been placed on the application. (viii) residential uses shall not be permitted, with the following exceptions: (1) housing for clergy employed at the property, as an accessory use. Such housing shall not exceed 4,000 square feet in floor area of habitable space, which shall be counted against the total floor area allowed on a site; or (2) continuation of a residential use existing on the property prior to the religious institution being established. Continuation of a residential use shall be limited in term and be subject to Interim Use Permit approval; The applicant has applied for an IUP to allow the single family home under a life estate. (ix) the property shall not be utilized for for -profit purposes, or regularly utilized by for - profit entities; The church is non-profit. (x) playgrounds and outdoor recreational areas shall be set back a minimum of 100 feet from residential property with adequate screening to protect neighboring properties from noise and adverse visual impacts; The applicant is not proposing to make changes to the playground area, although it is currently less than 100 feet from the western property line. Because it is non -conforming, the playground should not be expanded. (xi) the city council may require compliance with any other conditions, restrictions or limitations it deems to be reasonably necessary to protect the residential character of the surrounding area. Engineering Considerations Bonestroo has reviewed and approves of the proposed addition, subject to four conditions as referenced in their letter dated December 4, 2008. Building Official/Fire Considerations The applicant has been working with the Building Official for several months discussing building codes, fire codes, site concerns, and accessibility. The application includes the building being fire sprinklered and accessibility to be maintained. The Building Official is satisfied with the proposed application. Public Works Considerations The Public Works Superintendant recommends that if in the future traffic becomes a problem the driveway location be reviewed. At this time it is not recommended to move the location of the Woodridge Church CUP Amendment 7 August 11, 2009 Planning Commission driveway. The condition from the 1995 CUP has been transferred as a condition onto the new resolution. Minnehaha Creek Watershed District Considerations The applicant had originally intended to meet with Minnehaha Creek Watershed in December of 2008 but cancelled due to the moratorium. The applicant has agreed to meet with them if their application is approved and they move forward with the project. A Watershed permit will be required prior to the issuance of a building permit by the City. Conditional Use Permit Ordinance Compliance While reviewing Conditional Use Permits, City ordinances (Section 825.39) state that the City should consider the following: Subd. 1. That the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity. Staff has recommended conditions to limit the impact on adjacent property owners, including a condition requiring additional screening of headlights along the west side of the parking lot and driveway area. Subd. 2. That the establishment of the conditional use will not impede the normal and orderly development of surrounding vacant property for uses predominant in the area. The surrounding area is rural residential in character and does not impede the normal and orderly development of surrounding vacant properties. Subd. 3. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided. The Building Official/Fire Marshal has reviewed the plans and does not bring forward any major issues. The property is served off a County Road and proposes a new sewage treatment system and to sprinkler the building. Staff has placed a condition of approval the applicant provide a primary and alternate site that meets setback requirements from property lines and wetlands. Subd. 4. That adequate measures have been or will be taken to provide sufficient off-street parking and loading space toserve the proposed use. Staff has placed a condition of approval that the project meet requirements and proof of calculations be provided. Subd. 5. That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in such a manner that no disturbance to neighboring properties will result. The City will require lighting to comply with Section 829.04, where all lighting must be downcast in order to maintain a dark sky rural area. Woodridge Church CUP Amendment 8 August 11, 2009 Planning Commission Subd. 6. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Staff believes the current and proposed activities at the church are being provided as a service to the City. Subd. 7. The use is consistent with the purposes of the zoning code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Staff believes that with the recommended conditions, an expansion meeting the maximum square footage of not greater than 40, 000 square feet would be consistent with the zoning code and purposes of the zoning district. Subd. 8. The use is not in conflict with the policies plan of the City. Staff believes that with the recommended conditions, the use would not be in conflict. Subd. 9. The use will not cause traffic hazard or congestion. County Road 24 is a minor arterial roadway, and the access location does raise some concern. However, this is the location that the County provided for access when the church was originally constructed. Subd. 10. Existing businesses nearby will not be adversely affected by intrusion of noise, glare or general unsightliness. Staff believes that additional lighting controls will mitigate these impacts. Subd. 11. The developer shall submit a time schedule for completion of the project. The applicant originally planned to start construction in May of 2009 and complete the project December of 2009/January 2010. The applicant is awaiting approval before establishing a construction timeline. Subd. 12. The developer shall provide proof of ownership of the property to the Zoning Officer. The property is owned by the Woodridge Church. City Discretion The City has a relatively low level of discretion when it comes to reviewing Conditional Use Permits. If the application meets City ordinances, the CUP should be approved. However, the City may impose conditions on the approval that protect the best interests of the surrounding community and the city as a whole. As discussed above, the application is not consistent with City zoning requirements. The proposed addition exceeds the maximum allowed building size in the RPS district. As a result, the City cannot approve the CUP request. Woodridge Church CUP Amendment August 11, 2009 Planning Commission Consolidation of Resolutions Resolutions from previous years have been reviewed and conditions have been placed on the recommendation for approval. If this application is approved staff will draft a new resolution which will supersede previous conditional use permit approvals granted to the Property and resolutions 95-29, 98-41, and 99-66 will be declared null and void. RECOMMENDATIONS Staff recommends approval of the Interim Use Permit with regards to the residential use under the life estate. Because the proposed addition exceeds the maximum building size allowed in the zoning ordinance, staff does not believe that the City can approve the CUP request as proposed. However, there are alternatives for the City: Recommendation to Approve the CUP with Conditions: Planning staff recommends the following terms and conditions if the Planning Commission is to recommend approval of the CUP. The most important condition would be for the proposed addition to be re -designed in a way which is consistent with the requirements of the RPS district. Approving the CUP would allow conditions to be applied to the property consistent with the new RPS zoning district requirements. 1. The combined floor area of all structures shall not exceed 40,000 square feet and the footprint area of all structures on the parcel shall not exceed 35,000 square feet. 2. The number of parking stalls shall not exceed 300. Parking shall not occur outside of designated parking stalls except as allowed as part of a special event permit. The owner shall monitor parking and schedule activities in a way which does not lead to a parking need in excess of that provided; 3. Any new outdoor lighting shall be designed and installed so that the light is downcast only, with all sides enclosed except at the bottom the lens is recessed and the light source is not visible; 4. A photometric plan shall be submitted prior to a building permit being issued showing it meets reflective glare requirements for the entire parking lot, meeting requirements of the zoning district; 5. The applicant shall install active light controls to ensure that the minimum parking lot lighting is used based on the activities occurring on -site. 6. There shall be no outside telephone bells, speakers or amplified sound systems; 7. Sanctuary seating capacity shall not exceed 500 persons; 8. The number of persons on -site at any given time shall not exceed two times the capacity of the sanctuary, with the exception of larger events no more than four times per year. 9. The property shall not be utilized for for -profit purposes, or regularly utilized by for -profit entities; 10. Any roof top mechanical equipment shall be completely screened; 11. Landscaping Guarantee. The owner shall guarantee the growth and maintenance of all plants for a minimum of two growing seasons following an inspection of all completed plantings. 12. The applicant shall comply with the conditions outlined in the City Engineer's review letter dated December 4, 2008; 13. Erosion control shall be in place prior to any grading activity on the site and shall be maintained throughout the period of construction; 14. All septic sites shall be fenced and protected prior to beginning of grading or construction; Woodridge Church CUP Amendment 10 August 11, 2009 Planning Commission 15. A primary and alternate septic system design shall be provided which abides by all requirements, including minimum setback requirements. 16. The applicant shall execute and record an easement over the required wetland buffer area, and ensure that vegetation meets the requirements of the City's wetland protection ordinance; 17. The applicant shall obtain all necessary City and outside agency permits before construction; 18. The Applicant agrees to pay to the City all fees associated with the review and processing of these applications, including all those costs incurred by city staff and city consultants for the preparation and filing of all permits and documents; 19. Resolution 95-29: No parking shall be allowed on County Road 24 or on the driveway leading to the parking lot; 20. Resolution 95-29: Security lighting shall be controlled by a light sensor. All other exterior lighting shall be placed on a timing device. No exterior lighting shall be permitted when the building is not in use other than the exterior security lighting; 21. Resolution 95-29: The applicant agrees if the entrance driveway to County Road 24 becomes a problem in the future, the Applicant shall take corrective action. The City will determine if there is a problem and evaluate the appropriateness of the Applicant's proposed corrective action; 22. Resolution 95-29: The buildings and grounds shall be used only for church -related activities. Special events will require a special use permit, even though they are sponsored by the applicant; 23. Resolution 95-29: The sediment pond shall be returned to its original design. The depth at the outlet shall be monitored annually. When the depth has decreased below 4 feet, the pond shall be dredged out by the applicant. The applicant shall review this and report to the city; 24. Resolution 95-29: There shall be no permanent residential use of the facility, with the exception of the life estate under the IUP; 25. Resolution 95-29: The conditional use permit may be reviewed annually or as needed to insure compliance with all conditions set forth herein. Violation of any term of this conditional use permit may result in the imposition of additional conditions or in revocation of this conditional use permit; 26. Resolution 98-41: Trees shall be planted within all parking lot islands. 27. Resolution 99-66: The preschool/kindergarten shall be for children ages 3 through 6; 28. Resolution 99-66: The number of children at the preschool/kindergarten may not exceed 25; 29. Resolution 99-66: The hours of operation of the preschool/kindergarten shall be 8:30 a.m. to 2:45 p.m., Monday through Friday; 30. Resolution 99-66: Drop-off and pick-up of the children shall be at the south portion of the north parking lot; 31. The majority of the addition will be on the "back" or North and East side of the existing building. The program for the new space includes a new state of the art Student Ministry meeting space, some additional "shelled" Administration space for staff, additional classroom space for preschool children, gathering space for adults, a warming kitchen and improved circulation. The exterior building materials will be the same that were used on the existing facility so as to provide a seamless integration from old to new. See colored elevations A6.1 for material locations. Included as part of this project is a relocation and update of the existing septic system, sprinkling of the entire facility and an improved drop-off on the North side of the building. All of the mechanical units will be screened from County Road 24 by either landscaping /topography or roof top screening that integrates with the building materials. The first cell has a bottom of 988 which was the planned elevation and the surface area of the 988 contour is actually bigger than planned which indicates this cell was oversized during construction to allow for future sedimentation in the bottom. The berm between the two cells was planned at 991.0 feet but there is a small area of the berm that is slightly less than 990.0 feet, most likely caused by erosion from water running from the first to second cells. The second cell has a bottom contour of 988 with a low of 987.0 which is 4 feet deep. The planned bottom contour was 986 with a low of 985.0 feet. Also, the bottom contour today is smaller than what was planned. In addition, the current pond is more rounded off in the northeast, northwest and southwest corners where the original plan had some deeper grades in those corners. Usually you don't get much sediment in the second cell. Since it appears an as -built was never done, either the corners were filled in by erosion after construction or were never dug as planned. The ordinance established regulations related to the types of signs allowed in different zoning districts as well as size and setback regulations. Two years ago, the City adopted a moratorium on dynamic signage and adopted regulations as a result of the electronic billboards which began appearing in the Twin Cities. As part of these new regulations, the City also adopted a minimum font size requirement for signage visible from the road. The minimum font size is based on the speed limit of the adjacent road. The purpose of this regulation is because of the study completed on dynamic signage found that smaller text can be distracting for drivers The existing regulations can be found to the right: Speed Limit Min. Font Size <35 7 inches 35-44 9 inches 45-54 12 inches >54 15 inches As can be seen on the previous page, signs throughout the City do not abide by these font size minimums. There was almost no discussion on this subject during the Planning Commission and City Council discussion in which the font size regulations were added to the ordinance, because the discussion really surrounded the issue of dynamic signs. The Commission can drive past the signs referenced above for a demonstration of the visibility of these font sizes. As an example, the Baker Golf Course and Winter Recreational sign at the northwest corner of County Road 24 and Parkview Drive has 7 inch font. In order to list the name of this facility with 15 inch font (since County Road 24 is a 55MPH road), this sign would need to be twice the size (12 feet x 4 feet). Pylon Signs in Residential and Public/Semi-Public The primary issue to determine is if the Commission believes Pylon signs (with size and height limitations) should be allowed in these districts. As shown above, there are already a number of these signs existing today. The purpose for not allowing pylon signage (in effect requiring signs to be a monument design) in these districts is to avoid a "commercial" character in predominantly residential areas. The Commission should discuss if pylon signage with height and size limitations are consistent with residential surroundings. The signs shown above provide a reference for the discussion. The attached ordinance adds Pylon signs to the list allowed in residential districts and public/ semi-public districts. The ordinance limits the area of text and symbols on pylon signs to a maximum of 15 square feet (the sign structure itself may be larger). In the public/semi-public district, Pylon signs are limited to 8 feet in height. In residential districts, all signs will remain limited to 6 feet in height. Font Size Regulation The font size minimums discussed above have a major impact on the size of signs. Seven inch letters on signage close to the road, especially when perpendicular to the road, seems to be fairly legible. You have to be fairly close to the sign before the text can be read, but it is not distracting, especially when the surroundings are not cluttered. Police Chief Belland did not Sign Ordinance Amendment Page 3 of 4 August 11, 2009 Pylon Signage in Res. and PS Planning Commission Meeting believe 15-inch letters were necessary for traffic safety along faster roadways. He did note that text smaller than 7 inches is fairly difficult to read at 55 miles per hour. Generally, sign regulations limit the maximum size of signage rather than the minimum size. Obviously, this is going to be self-regulating to a certain point. A property owner will likely not pay to install a sign if it is not visible. With that being said, there are some examples above that are fairly difficult to read from the roadway. The draft ordinance exempts signs within 25 feet of the right-of-way from the font size minimums., The exception is dynamic signage, which must meet the font size requirements even if close to the road. The Commission can discuss this subject after visiting the signs throughout the City. There are many options with regards to the font size: ■ Remove font size minimums ■ Apply font size minimums only to dynamic signs ■ Apply font size minimums to signs further away from roads (currently in draft) ■ Apply font size minimums to all signs, reducing the required sizes (example: 7 inches adjacent to roadways 45+ miles per hour) ■ Apply font size minimums as currently required Staff Recommendation Staff recommends approval of the attached ordinance. With the limitations on height and size, along with landscaping requirements, the "commercial" feel of pylons signs will be greatly reduced. The regulations in the ordinance appear to be in line with the signs that the Park Commission is leaning towards for City Parks. General Provisions. In addition to the Signs allowed in Section 815.07, the following Signs are permitted in Residential Districts. A Sign permit is required for each Sign. No Sign in a Residential District shall exceed six (6) feet in height. If illuminated, the Sign shall meet the applicable luminary requirements set forth in Section 829 of the city's ordinances. Subd. 2. Permitted Signs. The following additional types of Signs are permitted in Residential Districts: (a) Directional Signs. One (1) Directional Sign is permitted for each property; (b) Monument Signs. Monument Signs are permitted at the entrance of a residential subdivision but shall be no greater than thirty (30) square feet and be landscaped around the perimeter of the base of the Sign. The landscaping shall cover at least two (2) times the total area of the Monument Sign base. The Monument Sign shall be set back at least ten (10) feet from the curb or right-of-way; and (c) Home Occupation Signs. Home occupation Signs shall be approved by the city council in conjunction with a conditional use permit for the home occupation. The home occupation Sign shall be no greater than eight (8) square feet, have only one (1) side, be set back at least ten (10) feet from the right-of-way. The home occupation Sign shall be landscaped around the perimeter of the base of the Sign. If the Sign is illuminated, it shall meet the applicable luminary requirements set forth in Section 829 of the city's ordinances. Subd. 2. Maximum Sign Area. The Signs on a Public -Semi Public or Rural Public/Semi- Public District property may consist of any of the types of Signs permitted by this Ordinance, but the Signs shall not exceed the following total Sign Area: Lot Size (Acres) Maximum Total Sign Area < 1 Acre 50 Square Feet 1.1 — 5 Acres 75 Square Feet 5.1 — 20 Acres 100 Square Feet Subd. 3. Permitted Signs. The following additional types of Signs are permitted in Public - Semi Public and Rural Public/Semi-Public Districts: (a) Monument Signs. A Monument Sign shall not consist of more than fifty (50) square feet of Sign Area. A Monument Sign shall not be greater than ten (10) feet in height. The Monument Sign's height shall be calculated by averaging the measurements of the final grade in elevation around the perimeter of the bottom of the Sign to the top of the Sign, with measurements in at least four (4) different places around the Sign required. The Monument Sign shall be landscaped around the perimeter of the base of the Sign. The landscaping shall cover at least two (2) times the total area of the Monument Sign base. A Monument Sign shall be set back at least twenty (20) feet from all lot lines of the property, with the exception that the Monument Sign may be setback only ten (10) feet from the front lot line of the property if it is located at least twenty-five feet from the side lot lines; (b) Wall Sign. General Sign Location, Design and Construction Requirements. Subd. 1. General Requirements. All Signs shall conform to the requirements of this Section whether or not a Sign permit is required. All Signs shall be constructed in such a manner and of such material that they shall be safe and substantial. All Signs shall be properly secured, supported and braced and shall be kept in good repair so that public safety and traffic safety are not compromised Subd. 2. Maintenance. The area on the property around the Sign on which it is erected shall be properly maintained and clear of brush, long grass, weeds, debris, rubbish and other obstacles. All burned -out light bulbs or damaged panels on a Sign shall be immediately replaced. Subd. 3. Sign Copy. All Sign copy shall be fastened securely to the Sign face and maintained on a regular basis. Any missing Sign copy shall be replaced immediately. Any Sign copy that is outdated must be removed within thirty (30) days. Subd. 4. Location. No Sign shall be located so as to obscure any existing Sign. No sign other than a governmental sign shall be erected or temporarily placed within any street right-of-way or upon any public easement. No Sign shall be attached or placed upon any building in such a manner as to obstruct any window or door or fire escape or be attached to any fire escape. The minimum clearance of any Sign from unprotected electrical conductors shall be not less than thirty-six (36) inches for conductors carrying not over six hundred (600) volts and forty-eight (48) inches for conductors carrying more than six hundred (600) volts. Subd. 5. Font Size. Every line of copy and graphics on a Sign greater than 25 feet from a right-of-way and which is visible from a the road must be at least seven (7) inches in height if the road has a speed limit of 25 to 34 miles per hour, nine (9) inches if the road has a speed limit of 35 to 44 miles per hour, twelve (12) inches if the road has a speed Ordinance No. ### 3 of 5 DATE limit of 45 to 54 miles per hour, and fifteen (15) inches if the road has a speed limit of 55 miles per hour or more. Subd. 6. Interference with Traffic. A Sign shall not be located within fifty (50) feet of any street, traffic sign or signal, intersection, driveway or crosswalk. A Sign may be located closer than fifty (50) feet if it can be shown that the Sign will not interfere with the ability of drivers and pedestrians to see the traffic sign or signal, intersection, driveway or crosswalk, and the Sign will not distract drivers nor cause any interference with such traffic sign or signal. Subd. 7. Illumination. Illuminated signs shall be subject to the electrical requirements of the electrical code of the State of Minnesota. Illuminated signs shall also be subject to the requirements of Section 829 of the city's ordinances. Subd. 8. Dynamic Displays. Dynamic Displays on Signs are allowed subject to the following conditions: (a) Dynamic Displays are allowed only on Monument and Pylon Signs. Dynamic Displays may occupy no more than thirty-five (35) percent of the actual copy and graphic area of the Sign. The remainder of the Sign must not have the capability to have a Dynamic Display even if it is not being used. Only one (1) contiguous Dynamic Display area is allowed on a Sign face; A Dynamic Display must not change or move more often than once every five (5) minutes, except for changes that are necessary to correct hour and minute, date, time or temperature information. Time, date or temperature information is considered to be one (1) Dynamic Display and may not be included as component of any other Dynamic Display. A display of time, date or temperature must remain for at least five (5) minutes before changing to a different display, but the time, date or temperature information itself may change no more often than once every three seconds; (c) The images and messages displayed on a Dynamic Display must be static, and the transition from one static display to another must be instantaneous and without any special effects; (d) The images and messages displayed on a Dynamic Display must be complete in themselves, without continuation in content to the next image or message or to any other Sign; (e) Every line of copy and graphics in a Dynamic Display must meet the font size requirements of subdivision 5 above, notwithstanding the distance of the D g amic Disnlav from the n t-of-way. If there is insufficient room for copy and graphics meeting these requirements, then no Dynamic Display is permitted; (b) Ordinance No. ### DATE 4 of 5 (0 Dynamic Displays must be designed and equipped to freeze the device in one position if a malfunction occurs. The display must also be equipped with a means to immediately discontinue the display if it malfunctions, and the Sign owner must immediately stop the Dynamic Display when notified by the city that it is not complying with the standards of this ordinance; (g) Dynamic Displays must comply with the brightness standards contained in this ordinance; and (h) Dynamic Displays existing on the effective date of this ordinance that do not meet the structural requirements or operational standards above may continue as a Non - Conforming Sign subject to Section 815.29. An existing Dynamic Display that cannot meet minimum font size requirements as stated in subdivision 5 above must use the largest size possible for one line of copy to fit in the available space.
