AN ORDINANCE, transferring the remaining fund balances and related
future revenues of the Bonfils Operating Fund and the Missouri Bottoms
Operating Fund to the Sanitary Replacement Fund and appropriating Two Hundred
Thirty Thousand Dollars ($230,000.00) from the Sanitary Replacement Fund to be
used for project costs for the construction of sanitary sewers in Benedetta
Lane Sanitary Relief (91091), in the City of Bridgeton, Missouri; and
confirming a contract with Fred M. Luth & Sons, Inc. for the construction of
the aforesaid sanitary sewers, in compliance with Section 9.040 of the Plan of
the District.
WHEREAS, the bid for the construction of said sanitary sewers is
One Hundred Seventy-five Thousand Four Hundred Ninety-six and 05/100 Dollars
($175,496.05), and the cost of engineering, inspection, construction staking,
advertisement costs and allowance for construction change orders is Fifty-four
Thousand Five Hundred Three and 95/100 Dollars ($54,503.95), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The remaining fund balances and related future
revenues of the Bonfils Operating Fund and the Missouri Bottoms Operating Fund
are hereby transferred to the Sanitary Replacement Fund and the sum of Two
Hundred Thirty Thousand Dollars ($230,000.00) is hereby appropriated from the
Sanitary Replacement Fund to be used for project costs for the construction of
sanitary sewers in Benedetta Lane Sanitary Relief (91091), in the City of
Bridgeton, Missouri. Section Two. The contract heretofore let by the
Executive Director to Fred M. Luth & Sons, Inc. as the lowest responsible
bidder for the construction of sanitary sewers in Benedetta Lane Sanitary
Relief (91091), in the City of Bridgeton, Missouri, with The Metropolitan St.
Louis Sewer District, pursuant to bids received and opened on the 30th day of
September, 1994 and formally executed on the 11th day of October, 1994 by said
contractor and by the Executive Director and Secretary-Treasurer on behalf of
the District is hereby confirmed, in compliance with Section 9.040 of the Plan
of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted October 12, 1994.
