AN ORDINANCE, amending Ordinance No. 9350, as adopted October 12,
1994, by deleting the words "The Mill Hill Corp." as they appear in the
preamble, the first WHEREAS clause, the second WHEREAS clause, and Section One,
and substituting the words "Voss Properties Corp." in lieu thereof.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST.
LOUIS SEWER DISTRICT:
Section One. The words "The Mill Hill Corp." as they appear in the
preamble, the first WHEREAS clause, the second WHEREAS clause and Section One
of Ordinance No. 9350, as adopted October 12, 1994, are hereby deleted.
Section Two. The preamble of Ordinance No. 9350, as hereby
amended, shall read as follows:
"AN ORDINANCE, appropriating Six Hundred Thousand Dollars ($600,00.00)
from the Operation, Maintenance and Construction Improvement Fund
of Lower Meramec River Basin to reimburse Voss Properties Corp. for
its costs incurred at the District's request for the construction
of a sanitary sewer which will eliminate the Hidden Valley
Treatment Facility."
Section Three. The first WHEREAS clause of Ordinance No. 9350, as
hereby amended, shall read as follows:
"WHEREAS, said Voss Properties Corp. will, at the District's
request, construct said sanitary sewer at a greater capacity than
required in order to properly serve the sewerage needs of the area,
and"
Section Four. The second WHEREAS clause of Ordinance No. 9350, as
hereby amended, shall read as follows:
"WHEREAS, said sanitary sewer as constructed by Voss Properties
Corp. will be dedicated to the District for public operation and
maintenance."
Section Five. Section One of Ordinance No. 9350, as hereby
amended, shall read as follows:
"Section One. The sum of Six Hundred Thousand Dollars
($600,000.00) is hereby appropriated from the Operation,
Maintenance and Construction Improvement Fund of Lower Meramec
River Basin to reimburse Voss Properties Corp. for its costs
incurred at the District's request for the construction of a
sanitary sewer which will eliminate the Hidden Valley Treatment
Facility."
The foregoing Ordinance was adopted November 9, 1994.
