AN ORDINANCE, vacating a portion of a sewer easement in "Proposed
Lot A" of the Resubdivision of Lots 3 & 4 of the Resubdivision of Lot 10 of
West Port Industrial Subdivision 3rd. Addition, a subdivision in the City of
Maryland Heights, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this
District to vacate the subject portion of said easement, and this District has
no further use for said portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described ten foot (10') wide portion
of sewer easement is hereby vacated, to wit:
Part of a 10 foot wide utility easement dedicated in Plat Book 126, Pages
80 and 81 of the St. Louis County Records, located Southwest of the
Northeast line of "Proposed Lot A" of THE RESUBDIVISION OF LOTS 3 &
4 OF THE RESUBDIVISION OF LOT 10 OF WEST PORT INDUSTRIAL
SUBDIVISION 3RD. ADDITION, and being more particularly described as
follows:
Commencing at the most Eastern corner of said "Proposed Lot A"; thence
along the Southeast line of said Lot South 53 degrees 30 minutes
West a distance of 50.10 feet to the Southwest line of said 10 foot
wide easement; thence along the Southeast line of said easement
North 40 degrees 10 minutes West a distance of 57.73 feet to an
angle point in said Southwest line; thence continuing along the
Southwest line of said easement North 39 degrees 49 minutes West a
distance of 251.00 to the true point of beginning of the herein
described easement to be vacated; thence continuing along the
Southwest line of said 10 foot wide easement North 39 degrees 49
minutes West a distance of 134.70 feet; thence leaving said
Southwest line North 50 degrees 11 minutes East a distance of 10.00
feet to the Northeast line of said 10 foot wide easement; thence
along the Northeast line of said easement South 39 degrees 49
minutes East a distance of 134.70 feet; thence leaving said
Northeast line South 50 degrees 11 minutes West a distance of 10.00
feet to the point of beginning, according to the plats recorded in
P.B. 126, Pages 80 & 81 and P.B. 327, Pg. 95 of the St. Louis
County Records.
The foregoing Ordinance was adopted November 9, 1994.
