AN ORDINANCE, appropriating Seven Hundred Fifteen Thousand Dollars
($715,000.00) from the Sanitary Replacement Fund to be used for project costs
for the construction of sanitary sewers in FC-01 Fenton Creek Sanitary Relief
Phase III (91001), in St. Louis County, Missouri; and confirming a contract
with JHB Contracting Company, Inc. for the aforesaid construction, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the aforesaid sanitary sewers is Six Hundred
Seventy-eight Thousand Six Hundred Thirty-nine and 29/100 Dollars
($678,639.29), and the allowance for construction change orders is Thirty-six
Thousand Three Hundred Sixty and 71/100 Dollars ($36,360.71), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Seven Hundred Fifteen Thousand Dollars
($715,000.00) from the Sanitary Replacement Fund is hereby appropriated to be
used for project costs for the construction of sanitary sewers in FC-01 Fenton
Creek Sanitary Relief Phase III (91001), in St. Louis County, Missouri.
Section Two. The contract heretofore let by the Executive Director
to JHB Contracting Company, Inc. as the lowest responsible bidder for the
construction of sanitary sewers in FC-01 Fenton Creek Sanitary Relief Phase III
(91001), in St. Louis County, Missouri, within The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 19th day of October, 1994
and formally executed on the 8th day of November, 1994 by said contractor and

by the Executive Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 8, 1994.
