O R D I N A N C E NO. 9416
AN ORDINANCE, appropriating Three Million Five Hundred Thousand
Dollars ($3,500,000.00) from the Sanitary Replacement Fund to be used for
project costs for the construction of sanitary sewers in Lemay Service Area
Overflow Regulation System, Lower River des Peres (L-01A), RDP Foulwater
Interceptor-Section A (93037A), in the City of St. Louis, Missouri; and
confirming a contract with J.H. Berra Const. Co., Inc. for the construction of
the aforesaid sanitary sewers, in compliance with Section 9.040 of the Plan of
the District.
WHEREAS, the bid for the construction of said sanitary sewers is
Three Million Two Hundred Ninety-seven Thousand Dollars ($3,297,000.00), and
the allowance for construction change orders is Two Hundred Three Thousand
Dollars ($203,000.00), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Million Five Hundred Thousand
Dollars ($3,500,000.00) is hereby appropriated from the Sanitary Replacement
Fund to be used for project costs for the construction of sanitary sewers in
Lemay Service Area Overflow Regulation System, Lower River des Peres (L-01A),
RDP Foulwater Interceptor-Section A (93037A), in the City of St. Louis,
Missouri.
Section Two. The contract heretofore let by the Executive Director
to J.H. Berra Const. Co., Inc. as the lowest responsible bidder for the
construction of sanitary sewers in Lemay Service Area Overflow Regulation
System, Lower River des Peres (L-01A), RDP Foulwater Interceptor-Section A
(93037A), in the City of St. Louis, Missouri, with The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 20th day of
October, 1994 and formally executed on the 8th day of November, 1994 by said
contractor and by the Executive Director and Secretary-Treasurer on behalf of
the District is hereby confirmed, in compliance with Section 9.040 of the Plan
of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 8, 1994.
