AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer to subordinate certain rights across a portion of a 10 foot (10')
wide easement owned by The Metropolitan St. Louis Sewer District to St. Louis
County, Missouri for the purpose of operating and maintaining a public roadway
known as:
Summit Top Circle, located in a tract of land being part of Lot 4 of
George Pickle's Subdivision in U.S. Survey 373, Sections 33 and 34,
Township 44 North, Range 5 East, St. Louis County, Missouri; said
easement being recorded in Book 9492, Page 2011 of the St. Louis
County, Missouri Records.
WHEREAS, the subordination of said rights in said easement will not
interfere with the sewer services provided therein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District does
hereby subordinate certain rights across a portion of an easement
owned by the District to St. Louis County, Missouri for the purpose
of operating and maintaining a public roadway known as: Summit Top
Circle, located in a tract of land being part of Lot 4 of George
Pickle's Subdivision in U.S. Survey 373, Sections 33 and 34,
Township 44 North, Range 5 East, St. Louis County, Missouri;
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized to execute on behalf of the District an instrument giving
effect to Section One hereof, said instrument to be comprised of such terms and
conditions as are approved by the office of the General Counsel of the
District.
The foregoing Ordinance was adopted December 8, 1994.
