AN ORDINANCE, appropriating Seven Hundred Eighty-six Thousand
Dollars ($786,000.00) from the Emergency Fund to be used for project costs for
the construction of sanitary sewers in Infrastructure Repair #147 (P.S. L-13
Rider Trail) 94100, in St. Louis County, Missouri; and confirming a contract
with Gershenson Construction Co., Inc. for the construction of aforesaid
sanitary sewers, in compliance with Section 9.040 of the Plan of the District,
with an emergency clause.
WHEREAS, the bid for the construction of said sanitary sewers is
Seven Hundred Forty-four Thousand Three Hundred Twenty-eight Dollars
($744,328.00), and the cost of a geotechnical investigation and report and
allowance for construction change orders is Forty-one Thousand Six Hundred
Seventy-two Dollars ($41,672.00), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Seven Hundred Eighty-six Thousand Dollars
($786,000.00) is hereby appropriated from the Emergency Fund to be used for
project costs for the construction of sanitary sewers in Infrastructure Repair
#147 (P.S. L-13 Rider Trail) 94100, in St. Louis County, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Gershenson Construction Co., Inc. as the lowest responsible bidder for the
construction of sanitary sewers in Infrastructure Repair #147 (P.S. L-13 Rider
Trail) 94100, in St. Louis County, Missouri, with The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 10th day of
January, 1995 and formally executed on the 11th day of January, 1995 by said
contractor and by the Executive Director and Secretary-Treasurer on behalf of
the District is hereby confirmed, in compliance with Section 9.040 of the Plan
of the District
Section Three. The construction as provided for in this ordinance
is necessary for the protection of public health and must proceed without
delay, thus creating an emergency within the meaning of the Plan; and
furthermore, since this ordinance is an appropriation ordinance, it shall take
effect immediately upon its enactment.
The foregoing Ordinance was adopted January 12, 1995.
