AN ORDINANCE, vacating a portion of a 10 foot (10') wide sewer
easement in a tract of land in the Southeast Quarter of the Southwest Quarter
and in the Southwest Quarter of the Southeast Quarter of Section 31, Township
45 North, Range 4 East, City of Ellisville, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this
District to vacate the portion of subject easement, and this District has no
further use for said portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portion of a ten foot (10')
wide sewer easement being part of an existing easement as recorded in the St.
Louis County Records in Deed Book 7288, Page 1148 and being a tract of land in
the Southwest Quarter of the Southeast Quarter of Section 31, Township 45
North, Range 4 East, City of Ellisville, St. Louis County, Missouri, as more
particularly described hereafter, is hereby vacated, to wit:
Commencing at an old stone marking the North Quarter corner of Section 6,
Township 44 North, Range 4 East, and also marking the Northeast
corner of Lot 859 of "Westglen Farms Plat One" (P.B. 193, Pages 20-
23); thence Easterly along the line between Township 44 North and
Township 45 North and along the North property line of property
conveyed to Mark Adolphus per D.B. 6929 Pg. 1878, North 89o57'26"
East 385.68 feet to a point being the Southeast corner of "Autumn
View Plat Two" (P.B. 324 Page 57); thence North 25o14'04" West
137.19 feet to a point; thence North 15o43'33" West 95.98 feet to a
point; thence South 06o21'04" East 135.00 feet to a point being the
intersection of the Southeast corner of Lot 77 of the aforesaid
"Autumn View Plat Two" at the North line of Autumn View Terrace (50
W.) Drive; thence along said Autumn View Terrace Drive along a
curve to the left whose radius point bears South 63o33'58" West
175.00 feet, an arc distance of 100.53 feet to a point of reverse
curve; thence along a curve to the right whose radius point bears
North 14o53'23" East 125.00 feet, an arc distance of 17.26 feet;
thence leaving said North line of Autumn View Terrace Drive, North
47o31'45" East 28.22 feet to the actual POINT OF BEGINNING of the
10 foot wide existing easement to be vacated; thence along a curve
to the right whose radius point bears North 16o21'55" East 100.00
feet, an arc distance of 11.32 feet to a point; thence North
47o31'45" East 64.24 feet to a point; thence South 15o36'23" East
6.93 feet to a point; thence South 17o10'01" West 7.79 feet to a
point; thence South 47o31'45" West 49.29 feet to the point of
beginning, is hereby vacated.
The foregoing Ordinance was adopted January 12, 1995.
