HomeMy Public PortalAbout09458 O R D I N A N C E NO. 9458 AN ORDINANCE, vacating any right, title or interest the District may have within a tract of land being part of a fifty (50) foot wide private road and public utility easement per Deed Book 4097, Page 113 and Deed Book 6305, Page 1993, which private road is sometimes known as West Questover Lane, and which road was also dedicated as an easement to St. Louis County Water Company per Deed Book 4135, Page 61 and being part of Lot 4 of the "SUBDIVISION OF JOHN HEZEL ESTATE" (Survey Record Book 8, Page 26) in U.S. Survey 1923, Township 45 North, Range 5 East, City of Creve Coeur, St. Louis County, Missouri. WHEREAS, the owner of this land has requested that this District vacate any right, title or interest that it may have in the subject private roadway and public utility easement, and this District has no further use therein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District hereby vacates any right, title or interest that it may have in the following described private roadway and public utility easement: Commencing at an old stone marking the southeast corner of "QUESTOVER SUBDIVISION PLAT NO. 2" (Plat Book 57, Page 31), which point is in the line between Lots 3 and 4 of the aforesaid Hezel Estate; thence southerly alongsaid line between Lots 3 and 4 and its southerly prolongation South 01o18'56" West 1090.35 feet to a point in the centerline of a 50 foot wide unimproved private roadway easement per Deed Book 4097, Page 113 and Deed Book 6305, Page 1993 sometimes referred to as West Questover Lane; thence along said centerline of West Questover Lane South 88o38'28" East 25.00 feet to the actual point of beginning; thence southerly and parallel to the aforesaid line between Lots 3 and 4 South 01o18'56" West 25.00 feet to a point in the south line of said West Questover Lane; 2 thence easterly along said south line South 88o38'28" East 460.70 feet to a point of curve; and along a curve to the right having a radius of 20.00 feet an arc distance of 31.85 feet to a point in the West line of a 50 foot wide private road easement established by Deed Book 4097, Page 113 and Deed Book 6305, Page 1993 and known as Questover Lane; thence northerly along said west line of Questover Lane the following: North 02o36'03" East 90.02 feet to a point in the north line of the aforesaid West Questover Lane; thence alongsaid north line along a curve to the right which radius point bears North 87o23'57" West 20.00 feet from the last mentioned point an arc distance of 30.98 feet to a point of curve; and North 88o38'28" West 462.69 feet to a point in a line 25.00 feet perpendicular distance East of and parallel to the aforesaid line between Lots 3 and 4 of the Hezel Estate; thence southerly and parallel to the aforesaid line between Lots 3 and 4 South 01o18'56" West 25.00 feet to the actual point of beginning. The foregoing Ordinance was adopted January 12, 1995.
