AN ORDINANCE, authorizing the amendment of the existing lease with
Lange-Stegmann Fertilizer Company, and directing the Executive Director and
Secretary-Treasurer, on behalf of The Metropolitan St. Louis Sewer District, to
execute an Amendment to the Lease Agreement with Lange-Stegmann Fertilizer
Company, a Missouri corporation, for certain real property of the District,
known and numbered as #1 Angelica Street, in the City of St. Louis, Missouri.
WHEREAS, said real property is being used by the Lessee for the
purpose of receiving, handling, bagging, storing and shipping fertilizer and
urea, and
WHEREAS, said lease was authorized by Ordinance No. 4131, adopted
August 7, 1980, and thereafter amended by Ordinance No. 4653, adopted March 3,
1982, Ordinance No. 8257, adopted December 12, 1990, and Ordinance No. 8834,
adopted December 11, 1992, and
WHEREAS, the Lessee wishes to expend substantial sums for the
construction of certain improvements upon said real property which will remain
the property of Lessee, has further requested an additional option to extend
said lease for five (5) years, and has requested certain other provisions all
of which are agreeable to the District for inclusion in the lease amendment as
herein authorized, and
WHEREAS, the use of said real property as herein specified does not
interfere with any District operation,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized to amend the existing lease with Lange-Stegmann Fertilizer

Company, and directed on behalf of The Metropolitan St. Louis Sewer District to
execute an Amendment to the Lease Agreement with Lange-Stegmann Fertilizer
Company, a Missouri corporation, for certain real property of the District
known and numbered as #1 Angelica Street, in the City of St. Louis, Missouri.
Section Two. The lease Amendment as herein authorized shall
provide for an additional five (5) year option to extend the lease term through
June 30, 2006, at the annual rental rate of Fifty-seven Thousand Three Hundred
Dollars ($57,300.00), subject to certain adjustments, and embody such other
terms and conditions as are approved by the office of the General Counsel of
the District.
The foregoing Ordinance was adopted February 9, 1995.
