HomeMy Public PortalAbout09490 O R D I N A N C E NO. 9490 AN ORDINANCE, vacating any right, title or interest of the District in a utility easement according to the quit claim deed recorded in Deed Book 10012, Page 1241 of the St. Louis County Records, being in U.S. Survey 3341 and Section 1 and in part of the Carondelet Commons, South of River des Peres in Township 43 North, Range 6 East, St. Louis County, Missouri. WHEREAS, the owner of this land has requested that this District vacate any right, title or interest that it may have in the subject utility easement and this District has no further use for said easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District hereby vacates any right, title or interest that it may have in the following described utility easement: Beginning at a point in the centerline of Interstate Highway I-270 (formerly I-255) at Station 80+00, as shown on the highway plans of the Missouri Highway and Transportation Commission, said point being opposite a notch cut in the Northern edge of the Eastbound lane of said highway, thence along the centerline upon the adopted bearing taken from said highway plans, North 66 degrees 43 minutes 48 seconds West 26.83 feet to a point being the point of intersection of centerlines of Highway I-270 and Telegraph Road (Route 231) being also at Station 79+73.17 of I-270 and Station 13+00.62 of Telegraph Road; thence leaving said centerline of I-270 and along the centerline of Telegraph Road, North 23 degrees 16 minutes 12 seconds East 434.42 feet to a point being Station 8+66.2; thence with an angle of deflection of 00 degrees 03 minutes 00 seconds left, North 23 degrees 13 minutes 12 seconds East 643.46 feet to a point being Station 2+22.74; thence at right angle to said centerline, South 66 degrees 46 minutes 48 seconds East 154.15 feet to a point on the eastern right-of-way line of said Telegraph Road, said point being offset left of said centerline station and being also the TRUE POINT OF BEGINNING of tract of land herein described; thence leaving said Eastern right-of-way line South 55 degrees 34 minutes 02 seconds West 105.68 feet to a point; thence South 19 degrees 29 minutes 00 seconds West 229.86 feet to a point; thence South 31 degrees 20 minutes 52 seconds East 220.79 feet to a point; thence North 84 degrees 57 minutes 01 seconds East 25.13 feet to a point, said point being 20 feet right of Station 81.+59.57 of the centerline of Outer Roadway Left as shown on said Highway I-270 plans; thence parallel with said centerline of Outer Roadway Left the following courses and distances: South 49 degrees 19 minutes 00 seconds East 156.00 feet to a point opposite Station 83+15.57; thence along a curve to the right, having a radius of 696.20 feet and a central angle of 17 degrees 03 minutes 15 seconds, an arc length of 207.22 feet to a point being opposite Station 85+28.75; thence South 32 degrees 15 minutes 45 seconds East 442.80 feet to a point being opposite Station 89+71.55; thence along a curve to the left having a radius of 736.20 feet and a central angle of 25 degrees 28 minutes 16 seconds, an arc length of 327.28 feet to a point of compound curve; thence along a curve to the left, having a radius of 2884.93 feet and a central angle of 9 degrees 00 minutes 04 seconds, an arc length of 453.22 feet to a point being opposite Station 97+40 (equation Station 97+40 I-270 100 feet left); thence South 66 degrees 44 minutes 05 seconds East 382.17 feet to a point; thence leaving said parallel line of said Outer Roadway Left, North 23 degrees 15 minutes 55 seconds East 107.66 feet to a point on the Northern right of way line of said Highway I-270; thence in a Westerly direction, along said Northern right of way line the following courses and distances: North 70 degrees 01 minutes 06 seconds West 397.88 feet to a point being Station 97+25, 185 feet Left; thence North 64 degrees 56 minutes 25 seconds West 160.08 feet to a point being Station 95+65, 190 feet Left; thence North 61 degrees 17 minutes 23 seconds West 316.43 feet to a point being Station 92+50, 220 feet Left; thence North 47 degrees 26 minutes 24 seconds West 105.95 feet to a point being Station 91+50, 255 feet Left; thence North 34 degrees 06 minutes 39 seconds West 296.82 feet to a point being Station 89+00, 415 feet Left; thence North 30 degrees 47 minutes 16 seconds West 247.03 feet to a point being Station 87+00, 560 feet Left; thence North 40 degrees 09 minutes 54 seconds West 111.80 feet to a point being Station 86+00, 610 feet Left; thence North 43 degrees 47 minutes 52 seconds West 141.16 feet to a point being Station 84+70, 665 feet Left; thence North 53 degrees 29 minutes 22 seconds West 174.64 feet to a point being Station 83+00, 705 feet Left; thence North 22 degrees 07 minutes 32 seconds West 136.46 feet to a point on the Eastern right of way line of Telegraph Road, said point being Station 5+00, 230 feet Left; thence North 20 degrees 37 minutes 03 seconds East 220.23 feet to a point being Station 2+80, 220 feet Left; thence North 25 degrees 46 minutes 15 seconds West 87.26 feet to the point of beginning. The foregoing Ordinance was adopted February 9, 1995.
