AN ORDINANCE, appropriating Two Hundred Fifty Thousand
Dollars ($250,000.00) from the Sanitary Replacement Fund to be used
for project costs for the procurement of Gates and Electric
Actuators (L-02E, 93039E) for the Lemay Service Area Overflow
Regulation System Pump Station and Gate Modifications, in the City
of St. Louis, Missouri; and confirming a contract with Hydrogate
Corporation for the furnishing of the aforesaid equipment, in
compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the furnishing of Gates and Electric
Actuators is Two Hundred Forty Thousand Dollars ($240,000.00), and
the allowance for change orders is Ten Thousand Dollars
($10,000.00), and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Fifty Thousand
Dollars ($250,000.00) is hereby appropriated from the Sanitary
Replacement Fund to be used for project costs for the procurement
of Gates and Electric Actuators (L-02E, 93039E) for the Lemay
Service Area Overflow Regulation System Pump Station and Gate
Modifications, in the City of St. Louis, Missouri.

Section Two. The contract heretofore let by the
Executive Director to Hydrogate Corporation as the lowest
responsible bidder for the furnishing of Gates and Electric
Actuators (L-02E, 93039E) for the Lemay Service Area Overflow
Regulation System Pump Station and Gate Modifications, in the City
of St. Louis, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 23rd day of
February, 1995 and formally executed on the 8th day of March, 1995
by said contractor and by the Executive Director and Secretary-
Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
