AN ORDINANCE, appropriating One Million Seven Hundred
Fifty Thousand Five Hundred Dollars ($1,750,500.00) from the
Emergency Fund to be used for project costs for the construction of
Missouri River Levee - 500 Year Flood Protection (94077) at the
Missouri River Wastewater Treatment Plant, in the City of Maryland
Heights, Missouri; and confirming a contract with Fred Weber, Inc.
for the construction of aforesaid levee, in compliance with Section
9.040 of the Plan of the District, with an emergency clause.
WHEREAS, the bid for the construction of said levee is
One Million Six Hundred Sixty-seven Thousand Two Hundred Three and
05/100 Dollars ($1,667,203.05), and the allowance for construction
change orders is Eighty-three Thousand Two Hundred Ninety-six and
95/100 Dollars ($83,296.95), and
WHEREAS, the State of Missouri has agreed to contribute
Five Hundred Thirty-six Thousand Six Hundred Sixty-six Dollars
($536,666.00) toward the costs of said project; upon the receipt of
such funds from said source, said money will be returned to the
Emergency Fund, and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:

Section One. The sum of One Million Seven Hundred Fifty
Thousand Five Hundred Dollars ($1,750,500.00) is hereby
appropriated from the Emergency Fund to be used for project costs
for the construction of Missouri River Levee - 500 Year Flood
Protection (94077) at the Missouri River Wastewater Treatment
Plant, in the City of Maryland Heights, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Fred Weber, Inc. as the lowest responsible
bidder for the construction of Missouri River Levee - 500 Year
Flood Protection (94077) at the Missouri River Wastewater Treatment
Plant, in the City of Maryland Heights, Missouri, with The
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 16th day of February, 1995 and formally executed
on the 8th day of March, 1995 by said contractor and by the
Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. The construction as provided for in this
ordinance is necessary for the protection of public health and must
proceed without delay, thus creating an emergency within the
meaning of the Plan; and furthermore, since this ordinance is an
appropriation ordinance, it shall take effect immediately upon its
enactment.

The foregoing Ordinance was adopted March 9, 1995.
