AN ORDINANCE, appropriating Four Hundred Seventy Thousand
Dollars ($470,000.00) from the Sanitary Replacement Fund to be used
for project costs for the construction of Phase I Odor Controls
(93054B) at the Lemay Treatment Plant, in St. Louis County,
Missouri; and confirming a contract with TGB, Inc. for the
aforesaid construction, in compliance with Section 9.040 of the
Plan of the District.
WHEREAS, the bid for the construction of the Phase I Odor
Controls is Four Hundred Forty-four Thousand Two Hundred Eight
Dollars ($444,208.00), and the allowance for change orders is
Twenty-five Thousand Seven Hundred Ninety-two Dollars ($25,792.00),
and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Four Hundred Seventy Thousand
Dollars ($470,000.00) is hereby appropriated from the Sanitary
Replacement Fund to be used for project costs for the construction
of Phase I Odor Controls (93054B) at the Lemay Treatment Plant, in
St. Louis County, Missouri.
Section Two. The contract heretofore let by the

Executive Director to TGB, Inc. as the lowest responsible bidder
for the construction of Phase I Odor Controls (93054B) at the Lemay
Treatment Plant in St. Louis County, Missouri, with The
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 30th day of March, 1995 and formally executed on
the 19th day of April, 1995 by said contractor and by the Executive
Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of
the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
