AN ORDINANCE, appropriating Three Hundred Ten Thousand
Five Hundred Dollars ($310,500.00) from the Operation, Maintenance
and Construction Improvement Fund of Sugar Creek to be used for
project costs for the construction of sanitary sewers in Briar Fork
Sanitary Relief (92020), in the City of Des Peres, Missouri; and
confirming a contract with Fred M. Luth & Sons, Inc. for the
construction of aforesaid sanitary sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Two Hundred Ninety-five Thousand Five Hundred Eighty-two
and 65/100 Dollars ($295,582.65), and the allowance for
construction change orders is Fourteen Thousand Nine Hundred
Seventeen and 35/100 Dollars ($14,917.35), and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Ten Thousand Five
Hundred Dollars ($310,500.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of Sugar
Creek to be used for project costs for the construction of sanitary
sewers in Briar Fork Sanitary Relief (92020), in the City of Des
Peres, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Fred M. Luth & Sons, Inc. as the lowest
responsible bidder for the construction of sanitary sewers in Briar
Fork Sanitary Relief (92020), in the City of Des Peres, Missouri,
with The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 21st day of March, 1995 and formally
executed on the 19th day of April, 1995 by said contractor and by
the Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 20, 1995.
