HomeMy Public PortalAbout09555 O R D I N A N C E NO. 9555 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to Deaconess Medical West Campus, certain real property of the District located in St. Louis County, Missouri and prescribing the terms of said transaction. WHEREAS, the real property hereinafter described has been declared as surplus pursuant to Resolution No. 2162, adopted December 8, 1994, and WHEREAS, pursuant to Resolution No. 2016, adopted September 18, 1991, said real property was appraised and publicly advertised for sale. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized to sell and convey to Deaconess Medical West Campus, certain real property of the District located in St. Louis County, Missouri for the total sale price of Fifty-eight Thousand Dollars ($58,000.00), said real property being described as follows: An irregular shaped tract of land totaling 1.85 acres, more or less, located on the northeast corner of relocated Dougherty Ferry Road and Des Peres adjacent to the intersection of Dougherty Ferry Road and Interstate 270 in southwest St. Louis County. A tract of land being part of Sections 3 and 4, Township 44 North, Range 5 East, in St. Louis County, Missouri, and being more particularly described as follows: 3 Commencing at a point located on the line between Sections 3 and 4, Township 44 North, Range 5 East. Said point also being the northwest corner of Lot 2 of "Shari Acres Addition", a subdivision recorded in Plat Book 233, Page 77 of the St. Louis County, Missouri Records; thence North 01 degrees 28 minutes 34 seconds East, along said line separating Sections 3 and 4, a distance of 980.02 feet to a point; thence South 88 degrees 31 minutes 26 seconds East, a distance of 16.23 feet to a point of intersection of the easterly right-of-way line of Des Peres (70 foot wide relocated) Road with the southerly right-of-way line of Dougherty Ferry (varying width) Road, and the point of beginning of the tract of land herein described; thence along said southerly right-of-way line of Dougherty Ferry Road, the following courses and distances: North 68 degrees 16 minutes 19 seconds East, a distance of 50.47 feet to a point of curvature; thence along a curve to the right, having a radius of 476.67 feet, an arc distance of 194.25 feet to a point; South 06 degrees 18 minutes 14 seconds West, a distance of 20.00 feet to a point; South 72 degrees 22 minutes 46 seconds East, a distance of 152.97 feet to a point; South 77 degrees 48 minutes 46 seconds East, a distance of 100.50 feet to a point; thence South 81 degrees 28 minutes 40 seconds East, a distance of 28.19 feet to a point of curvature (non- tangent), being the intersection of said southerly right- of-way line with the northerly line of Dougherty Ferry (84 foot wide) Road (relocated), as established per deed recorded in Book 8817, Page 1686 of the St. Louis County, Missouri Records; thence along said northerly right-of-way of Dougherty Ferry Road (relocated), the following courses and distances: thence along a curve to the left having a radius of 3861.83 feet, the chord of which bears South 71 degrees 08 minutes 44 seconds West for a distance of 339.34 feet, an arc distance of 339.40 feet to a point of tangency; 4 thence South 68 degrees 37 minutes 40 seconds West, a distance of 221.24 feet to the intersection of said northerly right-of-way line with the easterly right-of- way line of Des Peres (70 foot wide) Road (relocated); thence along said easterly right-of-way line of Des Peres Road (relocated), the following courses and distances: North 40 degrees 49 minutes 18 seconds West, a distance of 104.01 feet to a point of curvature (non-tangent); thence along a curve to the right, having a radius of 265.00 feet, the chord of which bears North 30 degrees 44 minutes 01 seconds East for a distance of 27.22 feet, an arc distance of 27.23 feet to a point of tangency; North 33 degrees 40 minutes 35 seconds East, a distance of 72.52 feet to a point of curvature; thence along a curve to the left having a radius of 335.00 feet, an arc distance of 75.58 feet to the point of beginning, said tract containing 80,452 square feet of 1.847 acres, more or less, according to a survey and calculations performed by Kenneth Balk & Associates, Inc. during October 1994. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above, and further to deposit the proceeds from said sale and conveyance in the reserve for Real Property Purchase, Improvement and Alterations Account. 5 The foregoing Ordinance was adopted May 11, 1995.
