AN ORDINANCE, appropriating Three Hundred Seventy
Thousand Dollars ($370,000.00) from the Operation, Maintenance and
Construction Improvement Fund of Gravois Creek to be used for
project costs for the construction of storm sewers in Fort Sumter
and Gravois Storm Sewer (94051), in St. Louis County, Missouri; and
confirming a contract with Bates Utility Company, Inc. for the
construction of the aforesaid storm sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Three Hundred Fifty-one Thousand One Hundred Five Dollars
($351,105.00), and the allowance for construction change orders is
Eighteen Thousand Eight Hundred Ninety-five Dollars ($18,895.00),
and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Seventy Thousand
Dollars ($370,000.00) is hereby appropriated from the Operation,
Maintenance and Construction Improvement Fund of Gravois Creek to
be used for project costs for the construction of storm sewers in
Fort Sumter and Gravois Storm Sewer (94051), in St. Louis County,
Missouri.

Section Two. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the construction of storm sewers in Fort
Sumter and Gravois Storm Sewer (94051), in St. Louis County,
Missouri, with The Metropolitan St. Louis Sewer District, pursuant
to bids received and opened on the 11th day of April, 1995 and
formally executed on the 19th day of April, 1995 by said contractor
and by the Executive Director and Secretary-Treasurer on behalf of
the District is hereby confirmed, in compliance with Section 9.040
of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
