AN ORDINANCE, appropriating Two Million Nine Hundred
Twenty-six Thousand Dollars ($2,926,000.00) from the Sanitary
Replacement Fund to be used for project costs for the construction
of sanitary sewers in GC-03 Hwy. 44 to White Cliff Park Sanitary
Relief (90025), in the Cities of Crestwood and Oakland, Missouri;
and confirming a contract with Bates Utility Company, Inc. for the
construction of aforesaid sanitary sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Two Million Seven Hundred Eighty-six Thousand Six Hundred
Ninety-nine Dollars ($2,786,699.00), and the allowance for
construction change orders is One Hundred Thirty-nine Thousand
Three Hundred One Dollars ($139,301.00), and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Nine Hundred Twenty-
six Thousand Dollars ($2,926,000.00) is hereby appropriated from
the Sanitary Replacement Fund to be used for project costs for the
construction of sanitary sewers in GC-03 Hwy. 44 to White Cliff
Park Sanitary Relief (90025), in the Cities of Crestwood and
Oakland, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the construction of sanitary sewers in GC-03
Hwy. 44 to White Cliff Park Sanitary Relief (90025), in the Cities
of Crestwood and Oakland, Missouri, with The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 18th
day of April, 1995 and formally executed on the 19th day of April,
1995 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted May 11, 1995.
