AN ORDINANCE, vacating any right, title or interest of
the District in a portion of Eatherton Road, being a forty foot
(40') wide roadway for public use in part of Fractional Section 26
in Township 45 North, Range 3 East, in St. Louis County, Missouri.
WHEREAS, the owner of this land has requested that this
District vacate any right, title or interest that it may have in
the subject roadway, and this District has no further use for said
roadway,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any right, title or interest that it may have in the
following described roadway:
A tract of land being part of Section 26, Township 45
North, Range 3 East, St. Louis County, Missouri and being
more particularly described as:
Beginning at a point in the South line of property
conveyed to Meta Stosberg and William Stosberg by deed
recorded in Book 1893, Page 172 of the St. Louis County
Records, said point being distant North 75 degrees 08
minutes 49 seconds East 11.02 feet from the intersection
of said South line of Stosberg property with the East
right-of-way line of Eatherton Road - Missouri State
Highway C, 60 feet wide; thence North 75 degrees 08
minutes 49 seconds East 23.01 feet along said South line
of Stosberg property to a point; thence South 47 degrees
30 minutes 04 seconds East 212.34 feet to a point; thence
South 37 degrees 00 minutes 04 seconds East 105.10 feet
to the North line of property conveyed to William B.
Gedney, Trustee by deed recorded in Book 8709, Page 1986
of the St. Louis County Records; thence North 88 degrees
36 minutes 20 seconds West 51.04 feet along the North
line of said Gedney property to a point; thence North 37
degrees 00 minutes 04 seconds West 69.73 feet to a point;
thence North 47 degrees 30 minutes 04 seconds West 112.25
feet to a point; thence along a curve to the left whose
radius point bears South 56 degrees 04 minutes 43 seconds
West 1114.68 feet from the last mentioned point, a
distance of 110.81 feet to the point of beginning and
containing 0.254 acres according to calculations by Volz,
Inc. during April, 1995.
The foregoing Ordinance was adopted June 8, 1995.
