AN ORDINANCE, vacating a portion of a 10 foot (10') wide
general utility easement in Lot 12 of "Ballwin's Cedar Valley", a
subdivision according to the plat thereof as recorded in Plat Book
175, Page 98 of the St. Louis County Recorder's Office, also being
in Section 35, Township 45 North, Range 4 East of U.S. Survey 1908,
and in the City of Ballwin, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portion of subject easement, and this
District has no further use for said portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portion of a ten
foot (10') wide general utility easement is hereby vacated, to wit:
Commencing at the southwest corner of Lot 12 of
"Ballwin's Cedar Valley"; thence South 89 degrees 36
minutes 00 seconds East along the southern lot line of
said Lot 12 a distance of 5.00 feet to the Actual Point
of Beginning; thence continuing along said southern lot
line South 89 degrees 36 minutes 00 seconds East a
distance of 62.50 feet to a point; thence leaving said
lot line, North 00 degrees 24 minutes 00 seconds East a
distance of 10.00 feet; thence North 89 degrees 36
minutes 00 seconds West a distance of 62.50 feet; thence
South 00 degrees 24 minutes 00 seconds West a distance of
10.00 feet to the Actual Point of Beginning.
The foregoing Ordinance was adopted July 13, 1995.
