AN ORDINANCE, appropriating Nine Hundred Forty-five
Thousand Dollars ($945,000.00) from the Sanitary Replacement Fund
to be used for project costs for the construction of sanitary
sewers in FC-01 Fenton Creek Sanitary Relief Phase IV (92004), in
St. Louis County, Missouri; and authorizing the Executive Director
and Secretary-Treasurer on behalf of The Metropolitan St. Louis
Sewer District to enter into a contract with Fred M. Luth & Sons,
Inc. for the aforesaid construction.
WHEREAS, the bid for the aforesaid sanitary sewers is
Eight Hundred Ninety-nine Thousand Fifty-nine and 75/100 Dollars
($899,059.75), and the allowance for construction change orders is
Forty-five Thousand Nine Hundred Forty and 25/100 Dollars
($45,940.25), and
WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Nine Hundred Forty-five Thousand
Dollars ($945,000.00) from the Sanitary Replacement Fund is hereby
appropriated to be used for project costs for the construction of
sanitary sewers in FC-01 Fenton Creek Sanitary Relief Phase IV
(92004), in St. Louis County, Missouri.

Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to enter into a contract with Fred M. Luth &
Sons, Inc. as the lowest responsible bidder for the construction of
sanitary sewers in FC-01 Fenton Creek Sanitary Relief Phase IV
(92004), in St. Louis County, Missouri, within The Metropolitan St.
Louis Sewer District, pursuant to bids received and opened on the
14th day of June, 1995.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
