AN ORDINANCE, amending Section Two of Ordinance No. 9550,
as adopted April 20, 1995, by repealing Rules 9.3 a., 13.4 d., 13.4
e., 13.4 f., 13.4 g., 13.4 j., and 13.5 b. 2. of the Civil Service
Rules and Regulations of The Metropolitan St. Louis Sewer District,
and enacting new Rules 9.3 a., 13.4 d., 13.4 e., 13.4 f., 13.4 g.,
13.4 j., and 13.5 b. 2. in lieu thereof.
WHEREAS, in accordance with Section 8.050 of the Plan,
the Civil Service Commission of The Metropolitan St. Louis Sewer
District held a public hearing on August 2, 1995 on proposed Civil
Service Rules and Regulations, recommended by the Personnel
Director; and
WHEREAS, the Civil Service Commission has approved and
submitted such Rules to the Board of Trustees as hereinafter set
out;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Section Two of Ordinance No. 9550, as
adopted April 20, 1995, is hereby amended by repealing Rules 9.3
a., 13.4 d., 13.4 e., 13.4 f., 13.4 g., 13.4 j., and 13.5 b. 2. of
the Civil Service Rules and Regulations of The Metropolitan St.
Louis Sewer District.
Section Two. There are hereby enacted new Rules 9.3 a.,
13.4 d., 13.4 e., 13.4 f., 13.4 g., 13.4 j., and 13.5 b. 2. of the
Civil Service Rules and Regulations of The Metropolitan St. Louis
Sewer District, said Rules to read as follows:
Rule Number
9.3 FREQUENCY OF PERFORMANCE APPRAISAL
An employee performance appraisal system shall provide
for the frequency of appraisals as follows:
a. Performance Appraisals of Regular Employees
The work of classified employees holding regular
appointments shall be appraised prior to completion
of each year of continuous service in an individual
step in a pay grade, and may be appraised on an
interim basis at the discretion of the appointing
authority or the Director of Personnel.
13.4 d. Starting Rate of Displacing Employees
If an employee displaces another employee in a
lower class, the employee's pay rate shall be the
highest step in the grade of the lower class which
is less than the employee's rate immediately prior
to displacement.
13.4 e. Starting Rate on Restoration
1. Original Position
When an employee is restored to the position
he/she occupied immediately prior to
displacement or layoff, his/her pay rate shall
be the rate of the same grade and step
occupied by the employee immediately prior to
displacement or layoff.
2. Position Lower Than Original Position
When an employee is restored to a position
lower than his/her position immediately prior
to displacement or layoff, his/her pay rate
shall be the rate for the highest step in the
grade of the position to which the employee is
restored which is less than the employee's

grade and step immediately prior to
displacement or layoff.
13.4 f. Starting Rate on Recall
1. Original Position
When an employee is recalled to his/her
position occupied immediately prior to
layoff, his/her pay rate shall be the
rate of the grade and step occupied by
the employee immediately prior to
displacement or layoff.
2. Position Lower Than Original Position
When an employee is recalled to a
position lower than his/her position
immediately prior to layoff, his/her pay
rate shall be the rate for the highest
step in the grade of the position to
which the employee is recalled which is
less than the employee's grade and step
immediately prior to displacement or
layoff.
13.4 g. Starting Rate on Promotion
The starting rate upon promotion shall be as
follows:
1. An employee promoted to a classified
position in Pay Schedule B shall be
placed in the lowest step in the higher
salary range which will provide the
employee a minimum increase equivalent to
one (1) regular pay increment over the
rate received immediately prior to
promotion.
2. An employee promoted to a classified
position in Pay Schedules A and C shall
be placed in a step in the higher pay

grade which will provide the employee
with an increase of at least 5% over the
rate received immediately prior to
promotion.

13.4 j. Rate of Pay Following Unsuccessful Promotional
Probationary Period
An employee who does not successfully complete
the probationary period following a promotion,
and who is returned to his/her former class or
to another class in the same pay grade, shall
have his/her pay reduced to the rate of the
grade and step received immediately before the
start of the promotional probationary period.
13.5 b. Periodic Advancement
2. An employee assigned to a classified
position in Pay Schedules A and C will be
appraised prior to completion of each
year of continuous service in an
individual step in a pay grade and all
increases within the salary range of the
position will be awarded considering
employee performance during the period in
question. Employee performance
appraisals will be monitored by the
Personnel Department. Except for an
employee occupying the lowest step in a
pay grade, an employee assigned to a
classified position in Pay Schedules A
and C who is appraised "Unsatisfactory"
will be reduced to one step lower in the
pay grade. An employee assigned to a
classified position in Pay Schedules A
and C will be eligible for advancement to
the next step of the pay grade after each
year of continuous service in an
individual step in the grade in
accordance with the Compensation Plan.

The foregoing Ordinance was adopted September 14, 1995.
