PRESENT: Chairman Dan Gareen, Members — Roy Hobbs, Dee Johnson, Jake Lindsay, John Lott, Bette Lovinus, Melanie Shirling, and Clerk Julie Hammond. ABSENT: None. VISITORS: Jean Thetford, Dave Radford, Kurt Roland, Steven Serr, Greg Hansen, and Brad Andersen. Chairman Garren welcomed everyone and Member Hobbs led with the Pledge of Allegiance. A roll call was taken to open the meeting. Minutes Approved: Member Lovinus moved to approve the Planning & Zoning (P&Z) Minutes of November 12, 2014 as written. Member Shirling seconded the motion. All were in favor, motion carried. Introduce New P&Z Members: Mayor Andersen introduced New P&Z Members: Dee Johnson, a former Iona City Council Member; Jake Lindsay, a successful businessman; and John Lott, a long time Iona resident and retired government employee. All live in Iona and have an Iona point of view. Chairman Garren welcomed the new members to a sometimes thankless but critical job. Chairman Garren moved to approve new P& Z Members: Dee Johnson, Jake Lindsay, and John Lott. Member Shirling seconded the motion. All were in favor, motion carried. With new members on board, there was an opportunity for current P&Z Members to renew their service or step down. Bonneville County Area of Impact Agreement/Area of Expansion: Bonneville County Commissioner Dave Radford and Bonneville County Planning, Zoning & Building Administrator Steven Serr attended Iona's Planning & Zoning Meeting to discuss updating City of Iona Ordinance #84 — Bonneville County Ordinance #206-01; Area of Impact Agreement, per City of Iona letter dated November 14, 2014. Iona needed more consistency with high density growth. Chairman Garren explained that the letter basically cleans up the current agreement and the meat of the letter is in Item #10 — Zones that can be considered in Iona. Administrator Serr indicated that you have to allow a variety of lot sizes so you are not discriminatory. Commissioner Radford stated that cities are dense in nature but outlying areas don't need to be. Iona is open to ideas if there is a better way to address the agreement. Proposed boundaries were looked at. It was explained that Iona was in the process of procuring a new site for a water tank and well on Telford Rd above the Scoresby place. This would supply future water needs including property to the north and south of Iona. Property to the west of Iona could be contracted through Falls Water. Idaho Code states there is a 30 to 60 day time frame to come to an agreement but negotiations could take longer. Bonneville County wanted to be good neighbors staying within certain parameters. Information obtained tonight would be brought back to the other Bonneville County Commissioners for review. Clerk Hammond would forward the proposed boundary map to Commissioner Radford and Administrator Serr. Mayor Andersen excused himself from the meeting at 7:05 p.m. Preliminary/Amended Plat Approval — Jean & Ken Thetford: Mrs. Thetford explained that they had purchased their home eight years ago assuming it was one lot instead of two. They would like to amend the plat to one lot so they are not assessed for two lots and return the water rights to Progressive Irrigation that they have never used. They had no plans to build on the lot. The City Engineer, Schiess & Associates had reviewed the plat and recommended the City approve the amended plat subject to meeting all Bonneville County plat amendment requirements. Member Lott moved to recommend to City Council to approve the amended plat subject to meeting all Bonneville County plat amendment requirements. Member Lovinus seconded the motion. All were in favor, motion carried. Preliminary/Amended Plat Approval — Rockwell Homes, Country Haven Estates: Mr. Hansen, Rockwell Homes explained that Rockwell had split Lot one of Block 2 for a City Park and reconfigured nine lots on the corner of Tanner Dr and Rebecca Way into eight lots for better access of approaches. The City Engineer, Schiess & Associates had reviewed the plat and recommended the City approve the amended plat subject to meeting all Bonneville County plat amendment requirements. Chairman Garren moved to recommend to City Council to approve the amended plat subject to meeting all Bonneville County plat amendment requirements. Member Lott seconded the motion. All were in favor, motion carried. Reports Chairman Garren asked new members to review City Code, especially Title 10 and Title 11, which is the part of code they would be dealing with as well as the Comprehensive Plan which outlines the direction of the City. Code updates and the Planning & Zoning Meeting Calendar were included in their documents. Iona will host training by Jim McNall of Idaho Counties Risk Management Program on February 24, 2015 at 7:00 p.m. for Council, P&Z, Idaho Rural Water Association, and certain districts. As outlined in this statute, a review of the Area of Impact Agreement should occur every 10 years. The current Area of Impact Agreement was adopted on January 24, 2001, and as such, this review process is now overdue. The City wishes to enact several changes to the ordinances currently in effect, all as set forth below; no changes to the current boundaries are anticipated at this time. The Iona City Council has reviewed the zoning established under the agreement in place and believes it does not align with the desires of the citizens of Iona, as outlined in the City of Iona Comprehensive Plan. Of particular note, the frequency of high -density housing is a concern we believe should be addressed. Specifically, updates to Section 9 of the current agreement are respectfully requested as follows: Section 9. Overlay requirements within the Iona Impact Area. The following regulations shall be forthwith adopted by ordinance of the County for use within the City area of impact aFea. 1. All non -arterial streets shall have a minimum right of way width of 70' or 60' with curb and gutter. 2. Setbacks for any structure from centerline of a street shall be 85' on arterials and 70' on non -arterials. 3. In all Residential zones, ae keeping of pigs is not a allowed. 4. Minimum staging lot size for all single family dwellings within the Iona Area of Impact tie and-14I4 Zones shall be 10,890 14.520 square feet in total area and shall be of a width at the front lot line of not less than 85 feet. 5. Minimum side yard for all single family dwellings within the Iona Area of Impact - e shall be a 10' setback with the exception of corner lots. which shall maintain a thirty (30) foot side yard setback adjacent to the street which intersects the street upon which the building fronts. Only the following county zones shall be considered for use within the Iona Area of Impact -area. A-1, RA-1, RA-2. RA-3. RA-4. and R-P, R 1 RA 2, C 1, M 1 A, LNC, I C 1 aftd-1,414. Section 67-6526 regulates the process of amending impact areas, including a hearing process by both the City and the County. In the original area of impact adoption process, some joint hearings were held with both the City and County boards meeting at the same time. We would be willing to consider that process again to aid in efficiently updating this agreement. We would appreciate a response on or before February 11. 2015.
