HomeMy Public PortalAbout09749 O R D I N A N C E NO. 9749 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a Lease Amendment with Thomas DeGrand d/b/a PRO AM Driving Range of St. Louis County, Missouri, whereby the District will lease additional real property to Thomas DeGrand, and extend the Lease term. WHEREAS, The Metropolitan St. Louis Sewer District has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for Open Space Purposes, and WHEREAS, Thomas DeGrand, d/b/a/ PRO AM Driving Range, has leased from the District a portion of said real property to be used in conjunction with a Golf Driving Range he operated, said lease having been authorized by Ordinance No. 8876, adopted February 10, 1993, and said lease and all options to terminate on December 30, 1997, and WHEREAS, Thomas DeGrand is desirous of amending said lease to encompass an additional 200 feet of District real property in order to continue the operations on said real property, and to extend the lease term, and WHEREAS, the execution of said lease will not interfere with the Open Space Purposes for which said real property was acquired. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a Lease Amendment with Thomas DeGrand d/b/a/ PRO AM Driving Range of St. Louis County, Missouri whereby the District will lease to Thomas DeGrand the following described real property: The northwest 350 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 350 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of-way. Section Two. The lease term shall commence on December 1, 1995 and continue for five (5) years to November 30, 2000 at the rental of Three Hundred Twenty-five Dollars ($325.00) per month, or a net yearly rental of Three Thousand Nine Hundred Dollars ($3,900.00) with an option to renew this lease for an additional term of five (5) years upon the same terms and conditions. Section Three. The Executive Director and Secretary- Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. The foregoing Ordinance was adopted December 14, 1995.
