AN ORDINANCE, appropriating a total of Six Hundred
Fifteen Thousand Seven Hundred Dollars ($615,700.00), to be funded
as follows: Four Hundred Thirty-eight Thousand Six Hundred Twenty-
four Dollars ($438,624.00) from the Operation, Maintenance and
Construction Improvement Fund of Blackjack-Dellwood, and One
Hundred Seventy-seven Thousand Seventy-six Dollars ($177,076.00)
from the Operation, Maintenance and Construction Improvement Fund
of Maline Creek, to be used for project costs for the construction
of storm sewers in Landseer-Ebert Storm Channel Phase IV (95024),
in St. Louis County, Missouri; and authorizing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St.
Louis Sewer District to enter into a contract with Mulligan
Construction, Inc. for the aforesaid construction.
WHEREAS, the bid for the construction of said storm
sewers is Five Hundred Eighty-six Thousand Three Hundred Fourteen
Dollars ($586,314.00), and the allowance for construction change
orders is Twenty-nine Thousand Three Hundred Eighty-six Dollars
($29,386.00), and
WHEREAS, the State of Missouri has agreed to contribute
One Thousand Nine Hundred Forty-one Dollars ($1,941.00) toward the
costs of said project; upon the receipt of such funds from said
source, said money will be returned to the Operation, Maintenance
and Construction Improvement Fund of Maline Creek, and

WHEREAS, the Director of Finance has certified that there
is an unencumbered balance in the above-named fund sufficient to
pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total sum of Six Hundred Fifteen
Thousand Seven Hundred Dollars ($615,700.00), to be funded as
follows: Four Hundred Thirty-eight Thousand Six Hundred Twenty-
four Dollars ($438,624.00) from the Operation, Maintenance and
Construction Improvement Fund of Blackjack-Dellwood, and One
Hundred Seventy-seven Thousand Seventy-six Dollars ($177,076.00)
from the Operation, Maintenance and Construction Improvement Fund
of Maline Creek is hereby appropriated to be used for project costs
for the construction of storm sewers in Landseer-Ebert Storm
Channel Phase IV (95024), in St. Louis County, Missouri;
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to enter into a contract with Mulligan
Construction, Inc. for the construction of storm sewers in
Landseer-Ebert Storm Channel Phase IV (95024), in St. Louis County,
Missouri, within The Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 1st day of November,
1995.
Section Three. This ordinance, being an appropriation

ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 14, 1995.
