AN ORDINANCE, authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to sell and convey to Dart Associates, L.L.C., certain
real property of the District located in St. Louis County, Missouri
and prescribing the terms of said transaction.
WHEREAS, the real property hereinafter described has been
declared as surplus pursuant to Resolution No. 2162, adopted
December 8, 1994, and
WHEREAS, pursuant to Resolution No. 2016, adopted
September 18, 1991, said real property was appraised and publicly
advertised for sale.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District
are hereby authorized to sell and convey to Dart Associates,
L.L.C., certain real property of the District located in St. Louis
County, Missouri for the total sale price of Five Hundred Twelve
Thousand Five Hundred Seventy-five Dollars ($512,575.00), with the
additional agreement that the District contribute Fifty Thousand
Dollars ($50,000.00) to Dart Associates, L.L.C. if it becomes
necessary to move the District's sewer line located on the
property, said real property being described as follows:
A tract of land being part of Sections 3 and 4, Township
44 North, Range 5 East, in St. Louis County, Missouri,
and being more particularly described as follows:
Commencing at a point located on the line between
Sections 3 and 4, Township 44 North, Range 5 East, said
point also being the Northwest corner of Lot 2 of "Shari
Acres Addition", a subdivision recorded in Plat Book 233,
Page 77 of the St. Louis County, Missouri Records;
thence North 01 degrees 28 minutes 34 seconds East, along
said line between Sections 3 and 4, a distance of 422.60
feet to the point of beginning of the herein described
tract;
thence South 78 degrees 25 minutes 34 seconds West, along
the northerly line of a tract of land conveyed to Russell
L. and Alice B. Sewall per deed recorded in Book 6015,
Page 264 of the St. Louis County, Missouri Records, a
distance of 121.34 feet to the intersection of said
northerly line with the easterly line of a tract of land
conveyed to the City of Des Peres, Missouri per deed
recorded in Book 9082, Page 80 of the St. Louis County,
Missouri Records;
thence North 11 degrees 39 minutes 16 seconds West, along
said easterly line, a distance of 73.76 feet to the
intersection of said easterly line with the northerly
line of said City of Des Peres, Missouri tract;
thence South 74 degrees 17 minutes 21 seconds West, along
said northerly line, a distance of 22.78 feet to the
intersection of said northerly line with the southerly
right-of-way line of Dougherty Ferry (varying width) Road
(relocated), as established per deed recorded in Book
8817, Page 1686 of the St. Louis County, Missouri
Records;
thence along said southerly right-of-way line, the
following courses and distances:
North 24 degrees 17 minutes 18 seconds East, a distance
of 57.79 feet to a point;
North 46 degrees 42 minutes 51 seconds East, a distance
of 217.52 feet to a point;
North 68 degrees 37 minutes 40 seconds East, a distance
of 236.46 feet to a point of curvature;
thence along said curve to the right, having a radius of
3777.82 feet, an arc distance of 382.91 feet to the
intersection of said southerly right-of-way line with the
westerly right-of-way line of Highland (varying width)
Avenue (relocated), as established per deed recorded in
Book 9850, Page 19 of the St. Louis County, Missouri
Records;
thence along said westerly line of Highland Avenue
(relocated), the following courses and distances:
South 42 degrees 07 minutes 41 seconds East, a distance
of 86.74 feet to a point of curvature (non-tangent);
thence along a curve to the left, having a radius of
376.48 feet, the chord of which bears South 56 degrees 41
minutes 58 seconds East for a distance of 288.15 feet, an
arc distance of 295.68 feet to a point of tangency;
South 79 degrees 11 minutes 56 seconds East, a distance
of 30.16 feet to a point;
South 80 degrees 04 minutes 59 seconds East, a distance
of 82.82 feet to a point;
South 64 degrees 50 minutes 36 seconds East, a distance
of 127.56 feet to a point of curvature;
thence along a curve to the right, having a radius of
412.46 feet, an arc distance of 365.41 feet to a point;
South 09 degrees 26 minutes 12 seconds East, a distance
of 78.45 feet to a point;
South 88 degrees 24 minutes 46 seconds East, a distance
of 20.00 feet to a point;
thence South 01 degrees 35 minutes 14 seconds West, along
said westerly right-of-way line, a distance of 110.48
feet to the intersection of said westerly right-of-way
line with the northerly line of a tract of land conveyed
to The Metropolitan St. Louis Sewer District per deed
recorded in Book 6761, Page 2314 as parcel numbered 2 in
the St. Louis County, Missouri Records;
thence North 88 degrees 19 minutes 06 seconds West, along
said northerly line, a distance of 125.92 feet to a
point;
thence North 55 degrees 07 minutes 53 seconds West, along
said northerly line, a distance of 435.07 feet to a
point;
thence North 01 degrees 52 minutes 18 seconds East, along
said northerly line, a distance of 27.89 feet to a point;
thence North 64 degrees 33 minutes 16 seconds East, along
said northerly line, a distance of 227.60 feet to a
point;
thence North 83 degrees 33 minutes 38 seconds West, along
said northerly line, a distance of 458.90 feet to a
point;
thence South 72 degrees 24 minutes 28 seconds West, along
said northerly line, a distance of 171.87 feet to a point
on the aforementioned line between Sections 3 and 4;
thence South 01 degrees 28 minutes 34 seconds West, along
said line between Sections 3 and 4, a distance of 20.00
feet to the point of beginning, said tract containing
478,548 square feet or 10.986 acres, more or less,
according to a survey and calculations performed by
Kenneth Balk & Associates, Inc. during October, 1994.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to execute and deliver a Special Warranty Deed
and any and all other documents as approved by the office of the
General Counsel of the District as may be necessary to effect the
sale and conveyance as authorized in Section One above, and further
to deposit the proceeds from said sale and conveyance in the
reserve for Real Property Purchase, Improvement and Alterations
Account.
