AN ORDINANCE, vacating any right, title or interest of the District in a portion
of a fifty foot (50') wide roadway for public use in Block 7 of Marlborough Manor, Section 10,
Township 44 North, Range 6 East, St. Louis County, Missouri.
WHEREAS, the owner of this land has requested that this District vacate any
right, title or interest that it may have in the subject roadway, and this District has no further
use for said roadway,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District hereby vacates any
right, title or interest that it may have in the portion of the fifty foot (50') right-of-way of
Birkenhead Drive as shown cross-hachured on the attached "Right-of-Way/Easement
Vacation Plat" and marked Exhibit "A" and made a part hereof, EXCEPTING THEREFROM,
the District's rights as established by the plat of "Radnor Place" a subdivision according to the
plat thereof as recorded in Plat Book 336, Page 66 of the St. Louis County Records.
The foregoing Ordinance was adopted February 15, 1996.
