AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District to sell and convey to Jose M. Oquendo
and Zenaida Oquendo, his wife, certain real property of the District located in St. Louis
County, Missouri and prescribing the terms of said transaction.
WHEREAS, the real property hereinafter described has been declared as surplus
pursuant to Resolution No. 2074, adopted October 14, 1992, and
WHEREAS, pursuant to Resolution No. 2016, adopted September 18, 1991, said
real property was appraised and publicly advertised for sale.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District are hereby authorized to sell and convey to Jose M.
Oquendo and Zenaida Oquendo, his wife, certain real property of the District located in St.
Louis County, Missouri for the total sale price of Eighty-seven Thousand Dollars
($87,000.00), said real property being described as follows:
TRACT A
A tract of land being part of Lot 43 of "Clifton Heights" a subdivision according
to the plat thereof recorded in Plat Book 1, Pages 16 and 17 of the St. Louis
County Records in Township 43 North, Range 6 East, St. Louis County,
Missouri and being more particularly described as follows:
Beginning at the Northwest corner of Lot B of "Christopher Acres" a subdivision
according to the plat thereof recorded in Plat Book 300, Page 91 of the St.
Louis County Records; thence along the boundary line of said Lot B the
following courses and distances: South 00 degrees 10 minutes 00 seconds
East 465.20 feet, South 49 degrees 57 minutes 50 seconds East 132.63 feet
and South 57 degrees 04 minutes 28 seconds East 398.27 feet to a point on
the North line of Christopher Drive 40 feet wide as traveled; thence along the
right-of-way line of Christopher Drive as traveled the following courses and
distances: North 73 degrees 00 minutes 28 seconds West 46.09 feet, along a
curve to the left whose radius point bears South 16 degrees 59 minutes 32
seconds West 180 feet from the last mentioned point, a distance of 176.88
feet, South 50 degrees 41 minutes 22 seconds West 304.06 feet, North 01
degree 52 minutes 38 seconds West 18.89 feet, South 50 degrees 41 minutes
22 seconds West 207.82 feet and along a curve to the left whose radius point
bears South 39 degrees 18 minutes 38 seconds East 435 feet from the last
mentioned point, a distance of 111.23 feet to a point on the East line of
"Barnwood Addition Plat 2" a subdivision according to the plat thereof recorded
in Plat Book 237, Page 49 of the St. Louis County Records; thence
Northwardly along said East line North 00 degrees 00 minutes 28 seconds
West 1174.39 feet to a point; thence South 89 degrees 32 minutes 57 seconds
East 246.52 to the point of beginning and containing 346,804 square feet or
7.962 acres.
TRACT B
A tract of land being part of the Northwest Quarter of Section 35, Township 43
North, Range 6 East St. Louis County, Missouri and being more particularly
described as follows:
Beginning at the Southeast corner of "Barnwood Addition Plat 4B" a
subdivision according to the plat thereof recorded in Plat Book 245, Page 90 of
the St. Louis County Records; thence South 89 degrees 40 minutes 52
seconds East 28.59 feet to a point on the West line of Christopher Drive 40
feet wide as travelled; thence Southwardly along said West line South 16
degrees 53 minutes 04 seconds West 348.38 feet to a point on the East line
of Property conveyed to Johann W. Bussen as described in the deed recorded
in Book 117, Page 402 of the St. Louis County Records; thence Northwardly
along said East line of the Bussen Property North 12 degrees 16 minutes 45
seconds East 341.33 to the point of beginning and containing 4774 square feet
or 0.110 acres.
TRACT C
A tract of land being part of the Northeast Quarter of the Northwest Quarter of
Section 35, Township 43 North, Range 6 East, St. Louis County, Missouri and
being more particularly described as follows:
Beginning at the Southeast corner of "Barnwood Addition Plat 4B" a
subdivision according to the plat thereof recorded in Plat Book 245, Page 90 of
the St. Louis County Records; thence Northwardly along the East line of
"Barnwood Addition Plat 4B" North 12 degrees 16 minutes 45 seconds East
69.43 feet to the most Southern corner of "Barnwood Addition Plat 2", a
subdivision according to the plat thereof recorded in Plat Book 237, Page 49 of
the St. Louis County Records; thence Northeastwardly along the Southeast line
of "Barnwood Addition Plat 2" North 31 degrees 16 minutes 22 seconds East
143.37 feet to a point; thence South 00 degrees 00 minutes 28 seconds East
48.56 feet to a point on the West line of Christopher Drive 40 feet wide as
traveled; thence Southwardly along said West line of Christopher Drive along a
curve to the left whose radius point bears South 56 degrees 52 minutes 33
seconds East 420 feet from the last mentioned point, a distance of 119.04 feet
and South 16 degrees 53 minutes 04 seconds West 36.00 feet to a point;
thence North 89 degrees 40 minutes 52 seconds West 28.59 feet to the point
of beginning and containing 5186 square feet or 0.119 acres.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a
Special Warranty Deed and any and all other documents as approved by the office of the
General Counsel of the District as may be necessary to effect the sale and conveyance as
authorized in Section One above, and further to deposit the proceeds from said sale and
conveyance in the reserve for Real Property Purchase, Improvement and Alterations Account.
The foregoing Ordinance was adopted April 18, 1996.
