HomeMy Public PortalAbout09849 O R D I N A N C E NO. 9849 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a Lease Amendment with Thomas DeGrand d/b/a PRO AM Driving Range of St. Louis County, Missouri, whereby the District will grant an additional five (5) year option to lease certain real property as previously leased to Thomas DeGrand. WHEREAS, The Metropolitan St. Louis Sewer District has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for Open Space Purposes, and WHEREAS, Thomas DeGrand, d/b/a/ PRO AM Driving Range, has leased from the District a portion of said real property to be used in conjunction with a Golf Driving Range he operates, said lease having been authorized by Ordinance No. 8876, adopted February 10, 1993, and said lease and all options to terminate on November 30, 2005, and WHEREAS, Thomas DeGrand is desirous of amending said lease to acquire an additional five (5) year option for the lease of said real property, and to extend the lease term, and WHEREAS, the execution of said lease amendment will not interfere with the Open Space Purposes for which said real property was acquired. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a Lease Amendment with Thomas DeGrand d/b/a/ PRO AM Driving Range of St. Louis County, Missouri whereby the District will grant an additional five (5) year option on the following described real property: The northwest 350 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 350 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of-way. Section Two. The Lease Amendment as herein authorized shall provide for an additional five (5) year option to extend the lease term of said real property, said additional lease term to commence on December 1, 2005 and terminate on November 30, 2010; with all other lease conditions to be renegotiated by the parties at such time as said option is exercised. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Amendment giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. The foregoing Ordinance was adopted April 18, 1996.
