PRESENT: Members — Roy Hobbs, John Lott, Bette Lovinus, Melanie Shirling, and Clerk Julie Hammond. ABSENT: Chairman Dan Garren, Members — Dee Johnson and Jake Lindsay. VISITORS: Rod Gardner, Susan Gardner, Barbara Schreier, Alice B. Olsen, and Robert Del Bodily. Acting Chairman Shirling welcomed everyone and Member Lovinus led with the Pledge of Allegiance. A roll call was taken to open the meeting. Minutes Approved: Member Hobbs moved to approve the Planning & Zoning (P&Z) Minutes of January 14, 2015 as written. Member Lovinus seconded the motion. All were in favor, motion carried. R&S Properties Rezone of Commercial Property to Residential Townhouse located at 5122 E Owens Ave Public Hearing — 6:30 p.m.: Acting Chairman Shirling explained the public hearing process and asked Mr. Gardner of R&S Properties to present the Application for Rezone, Exhibit "A." Mr. Gardner explained that R&S Properties, a property rental business, had purchased the property at 5122 E Owens Ave with the intent to rent the home but the home had not been lived in for the last ten years and the wiring was bad. He proposed building a twin home on the property with one entrance from Walker Ave and one entrance from Owens Ave. The property is just shy of two, 1/3 acre lots. They would like to utilize the property similar to existing, neighboring properties. Mr. Gardner thought the congestion from a rental property would be less than from a commercial property and that is why they were requesting a rezone. Acting Chairman Shirling opened the public portion of the hearing; those in favor, none; neutral, one; opposed, two. Barbara Schreier of 5130 Walker Ave was opposed. She lives right across the street from the property and there is too much traffic as it is from the day care. Alice Olsen of 3180 Olsen St was neutral. She was also concerned about the traffic. Acting Chairman Shirling entered and read Exhibit "A-1," written comments from Dorothy Jenkins, into the record. Dorothy Jenkins of 5131 E Owens Ave was opposed. She was concerned about the traffic that a townhouse would bring. Mr. Gardner proceeded with his rebuttal. He explained that the traffic should be minimal since there would be one family entering/exiting from Walker Ave and one family entering/exiting from Owens Ave. Mrs. Gardner added that each home would probably have two bedrooms and be wheel -chair accessible. The public portion of the hearing was closed. Member Lott asked the direction of traffic on Walker Ave; West, when followed. Member Lovinus thought that changing the zoning from Commercial (C) to Residential Townhouse (R-T) would help keep traffic to a minimum. Member Hobbs was concerned with the continuation of commercial zoning and what kind of impact it would have by changing one property to R-T in the middle of a commercial zone. He also wondered if the property was rezoned to R-T how hard would it be to go back to commercial. Member Lovinus was concerned about having enough room for the property but thought it was feasible to have a duplex there. Member Lott didn't see any reason to deny the rezone. Member Lovinus moved to recommend to Council to approve R&S Properties Application for Rezone at 5122 E Owens Ave from Commercial to Residential Townhouse. Member Lott seconded the motion. All were in favor, motion carried. Cell Tower Ordinance, Exhibit "B," — Amending Sections 11-6-3 and 11-7-3 Conditional Uses Public Hearing: Acting Chairman Shirling reminded everyone of the public hearing process. She read the summary of the proposed ordinance and explained that the ordinance allowed cell towers as a conditional use in sections 11-6-3 Commercial Zone and 11-7-3 Industrial Zone. The purpose of the ordinance was to regulate wireless communication towers and antennas due to Federal Regulations permitting structure and usage. Acting Chairman Shirling opened the public portion of the hearing; those in favor, none; neutral, none; opposed, none. Member Lott was concerned with the health and safety of residence due to microwaves. Member Hobbs explained that Bonneville County had just approved a cell tower near the railroad tracks. Everyone was reminded that this was a regulating ordinance. Member Lovinus moved to recommend to Council to approve Amending Sections 11-6-3 and 11-7-3 of the Iona City Code. Member Hobbs seconded the motion. All were in favor, motion carried. Cell Tower Ordinance, Exhibit "C," — Adopting a New Chapter 2 of Title 10 Relating to Wireless Communication Towers Public Hearing: Acting Chairman Shirling reminded everyone of the public hearing process. She read the summary of the proposed ordinance and explained that the ordinance adopted a new Chapter 2 of the Iona City Code regulating wireless communication towers and antennas. Acting Chairman Shirling opened the public portion of the hearing; those in favor, none; neutral, none; opposed, none. Member Lovinus moved to recommend to Council to approve Adopting a New Chapter 2 of Title 10 Relating to Wireless Communication Towers, of the Iona City Code. Member Lott seconded the motion. All were in favor, motion carried. Firearms Usage — Repeal of Section 11-11-18 Ordinance, Exhibit "D," Public Hearing: Acting Chairman Shirling reminded everyone of the public hearing process. She read the summary of the proposed ordinance. Acting Chairman Shirling opened the public portion of the hearing; those in favor, none; neutral, none; opposed, none. Member Lovinus explained repealing Section 11-11-18 because Idaho Code regulates the use, possession, and concealment of firearms, weapons, and explosives. Member Lott moved to recommend to Council to approve Repealing Section 11-11-18 Firearms Usage of the Iona City Code. Member Lovinus seconded the motion. All were in favor, motion carried. Reports Area of City Impact Training: Chairman Garren, and Members Hobbs, Lott, and Lovinus attended the Area of City Impact Training hosted by the City of Idaho Falls. Member Hobbs gave highlights of the training that included: • Growth Projection should look further out than 10 years. • Protecting Agricultural as much as possible; taxes help provide for these lands. • City taxes are higher than County taxes. • Impact areas should be annexed prior to any construction. Member Lott pointed out that State Law is not adequate on Area of City Impact and collaboration needs to be done between City and County. The training was well worth his time. Government "101" Training: Iona will host training by Jim McNall of Idaho Counties Risk Management Program on February 24, 2015 at 7:00 p.m. for Council, P&Z, Idaho Rural Water Association, certain districts, and neighboring cities. Meeting Attendance: Clerk Hammond was asked to e-mail members regarding meeting attendance as well as adding it to next month's agenda.
