HomeMy Public PortalAbout10057 O R D I N A N C E NO. 10057 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the City of Valley Park, Missouri certain real property of the District in St. Louis County, Missouri, being part of the Grand Glaize Treatment Plant property for the construction of a levee on the Meramec River to protect said City from flooding, and prescribing the terms of said transaction. WHEREAS, the City of Valley Park, Missouri requires said real property of the District for the construction of a levee on the Meramec River to protect said City from flooding, and is empowered to acquire same through the exercise of eminent domain, and WHEREAS, the City of Valley Park, Missouri will raise the berm on the District's Grand Glaize Treatment Plant property in order that the large lagoon cell thereon will maintain present capacity and additionally will provide the District with ingress and egress to the Grand Glaize Treatment Plant over the levee to be constructed when the Grand Glaize Parkway is flooded, and WHEREAS, the District is willing to sell and convey said real property to the City of Valley Park, Missouri for such public use, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized to sell and convey to the City of Valley Park, Missouri certain real property of the District in St. Louis County, Missouri, being part of the Grand Glaize Treatment Plant property for the construction of a levee on the Meramec River to protect said City from flooding, for the total sale price of One Dollar ($1.00), said real property being described as follows: A tract of land being part of Blocks 53, 54 and 56 of "Valley Park", a subdivision according to the plat thereof recorded in Plat Book 6, Pages 10 and 11 of the St. Louis County Records, part of 9th Street, 50 feet wide (vacated), part of 10th Street, 50 feet wide (vacated), part of Barthold Avenue, 50 feet wide (vacated), part of Napton Avenue, 50 feet wide (vacated), part of the Alleys, 15 feet wide, in Blocks 53 and 54 (vacated), part of U.S. Survey 1970 and part of Section 17 in Township 44 North - Range 5 East, St. Louis County, Missouri. Deed description to govern. Section Two. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above. The foregoing Ordinance was adopted March 13, 1997.
