AN ORDINANCE, repealing Ordinance No. 9913, as adopted July 11, 1996, and
enacting a new ordinance in lieu thereof, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the City
of St. Louis, Missouri certain real property of the District located in the City of St. Louis,
Missouri (District Site No. 121), and prescribing the terms of said transaction.
WHEREAS, said real property is located along the River des Peres, and
because of its location, it has no commercial or residential value, and
WHEREAS, the City of St. Louis, Missouri desires to acquire said real property
for use for public park purposes, and
WHEREAS, said real property is of no use to the District, and has been
declared as surplus pursuant to Resolution No. 2220, adopted June 13, 1996,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinance No. 9913, as adopted July 11, 1996, is hereby
repealed.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the
City of St. Louis, Missouri certain real property of the District located in the City of St. Louis,
Missouri for the total sale price of One Dollar ($1.00), said real property being described as
follows:
A parcel of land located in City Block 3283 of the City of St. Louis, the point of
beginning being in the northeast line of Nellie Avenue, 60 feet wide, and said
point also being the westernmost corner of Lot 10 of Karleskind's Subdivision of
Block 7 of Payne's Subdivision of Block 130 of Carondelet Commons South of
the River des Peres, according to the plat thereof recorded in Plat Book 4,
Page 37 of the St. Louis County Recorder's Office; thence along the northwest
line of said Lot 10, North 35 degrees 50 minutes 00 seconds East a distance
of 132.12 feet to a point in the western line of the River des Peres Drainage
Works right-of-way; thence along said western line, along a curve to the right
having a radius of 1,497.28 feet, an arc distance of 159.66 feet to said
northeast line of Nellie Avenue, 60 feet wide; thence along the aforesaid line of
Nellie Avenue, North 54 degrees 10 minutes 00 seconds West a distance of
89.50 feet to the point of beginning.
Section Three. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a
Special Warranty Deed and any other documents as approved by the office of the General
Counsel of the District as may be necessary to effect the sale and conveyance of the real
property as authorized in Section Two above, and further to deposit the proceeds from said
sale and conveyance in the Reserve for Real Property Purchase Improvement and Alterations
Account.
The foregoing Ordinance was adopted May 8, 1997.
