PRESENT: Chairman Dan Garren, Members —Dee Johnson, Jake Lindsay, John Lott, Melanie Shirling, and Clerk Julie Hammond. ABSENT: Members - Roy Hobbs and Bette Lovinus. VISITORS: Mike Bryan, Louise Bryan, Brad Andersen, and Finn Garren. Chairman Garren welcomed everyone and Member Shirling led with the Pledge of Allegiance. Minutes Approved: Member Johnson moved to approve the Planning & Zoning (P&Z) Minutes of March 11, 2015 as written. Member Shirling seconded the motion. All were in favor, motion carried. Mayor Andersen — Planning & Zoning Thank You: Mayor Andersen, on behalf of the City and Council, thanked Planning & Zoning (P&Z) Members for their service and gave them a small token of appreciation. P&Z Members are un-paid volunteers that are the first point of contact on zoning issues. Mayor Andersen excused himself from the meeting at 6:32 p.m. Quitclaim Deed — Vacating a Public Alley to Mike and Louise Bryan of 5013 Steele Ave - Public Hearing: Chairman Garren explained the public hearing process and asked the Bryan's to present the Quitclaim Deed. Mike Bryan indicated that there was a 15' abandoned drainage ditch on the west side of their property located at 5013 Steele Ave. They would like to claim the property so they can fill in the ditch, plant grass, and install a sprinkler system. Attorney Storer worked with Public Works Director Prouse to draft a Quitclaim Deed vacating the City owned property to the Bryan's. Chairman Garren opened the public portion of the hearing; those in favor, none; neutral, none; opposed, none. Chairman Gan -en closed the public portion of the hearing and opened discussion to P&Z Members. Member Lindsay and Member Lott were concerned about neighbors having access to the water. The Bryan's indicated that as far as they knew no one used the ditch to water (now or ever) because all properties to the south of them had already filled in the ditch and others used the main ditch off of Olsen. There was no further discussion. Chairman Garren entertained a motion. P&Z Member Johnson moved to recommend to Council to approve the Bryan's Quitclaim Deed and Ordinance, Exhibits `B" & "C." P&Z Member Lindsay seconded the motion. All were in favor, motion carried. fiN Area of Impact Agreement Update: Chairman Garren spoke with Bonneville County Commissioner Dave Radford. He indicated that if we can get the changes through Bonneville County Planning & Zoning it would not be necessary to take it to the Commissioners. Clerk Hammond would send an electronic copy to Chairman Garren and P&Z Members of the Impact Area Updates outlined in the November 14, 2014 letter to Roger Christensen, Bonneville County P&Z Chairman. Chairman Garren would work with Steve Serr of Bonneville County to try and get everything ironed out. Chairman Garren gave some background on the Impact Area Agreement to P&Z's new members. He stated the Impact Area Agreement between Bonneville County and Iona was dated 2001 (which should be updated every 10 years) and the Comprehensive Plan was completed in 2007. The Comprehensive Plan indicates that the citizens want larger lots in the community. This is reflected in the proposed updates. Pursuant to the provisions of Idaho Code Sections 50-311 and 50-1325, as amended, this alley is hereby vacated in favor of the adjacent landowners named in Section 2 of this Ordinance. Section 2. Execution of Quitclaim Deed to Mike and Louise Bryan. That the portion of the alley more particularly described in Exhibit "A" attached hereto, be and hereby is vacated and the Mayor and City Clerk are authorized and directed to execute and deliver a Quitclaim Deed conveying said portion to the following, namely: Name Address Mike and Louise Bryan 5013 Steele Ave. Iona, Idaho 83427 Exhibit "C" Section 3.
