PRESENT: Chairman Dan Garren, Members — Roy Hobbs, Dee Johnson, Jake Lindsay, John Lott, Bette Lovinus, and Clerk Julie Hammond. ABSENT: Member Melanie Shirling. VISITORS: Rod Gardner, Susan Gardner, Michelle Smoley, Tim Smoley, and Cheryl Smoley. Chairman Garren welcomed everyone and Member Lovinus led with the Pledge of Allegiance. Minutes Approved: Member Lott moved to approve the Planning & Zoning (P&Z) Minutes of April 8, 2015 as written. Member Johnson seconded the motion. All were in favor, motion carried. Luv Em Lots Childcare — Conditional Use Permit Public Hearing: Chairman Garren explained the public hearing process and asked Michelle Smoley to present her application. Michelle Smoley of 3044 Olsen Street stated that she applied for a Conditional Use Permit (CUP) to run a small in -home daycare. She explained that she was licensed with the State of Idaho as an ICC Daycare (low-income/welfare). Ms. Smoley stated that children were dropped off at 5:30, 6:30, and 7:30 a.m. and picked up at 2:00, 2:30, and 5:30 p.m. There would be no additional effects on adjoining property with only five children. The north side of the property had a privacy fence and the south side had a chain link fence. Chairman Garren opened the public portion of the hearing; those in favor, one; neutral, one; opposed, none. Rod Gardner of 2727 N Foothill Rd was neutral. He thought it was a good idea. Tim Smoley of 4981 Denning Ave was in favor. He stated he was the property owner of 3044 Olsen Street and did not have any problem with a daycare at the location. Chairman Garren closed the public portion of the hearing and opened discussion to P&Z Members. Member Lindsay asked if Ms. Smoley anticipated any changes in the arrival and pick-up times. No; arrival and pick-up times were based on parents work schedules. Member Lott wanted to know how long she had been running her daycare at this location. Two weeks. She has run the daycare for several years and for a time in Iona at 3203 Barnes Way. Member Lott asked if neighbors had been notified; neighbors within 300' of the property had been notified. Member Johnson moved to recommend to Council to approve Michelle Smoley's, Luv Em Lots Childcare CUP Application, Exhibit "A." Member Lindsay seconded the motion. All were in favor, motion carried. Rod & Susan Gardner — Amended Plat — Located at 5122 Owens Ave: Mr. Gardner explained that they had the property at 5122 Owen Ave re -platted; splitting the one lot into two, with the intent of building a patio home on each lot. Mr. Long, neighbor to the west of the property, had built his fence and shop on the property but they would sell him the property if the re -plat was accepted by the City. The contracted City Engineer, Schiess & Associates, thought that water and sewer services would need to run along the side of the property (water lines for both lots in one trench down one side and sewer lines for both lots in one trench down the other side). Overall, it appeared to be an acceptable plat if the utility services can be worked out and building requirements were met. Planning & Zoning Members agreed that this was an acceptable plat as long as they met the building setback requirements. Member Lindsay moved to recommend to Council to approve Rod & Susan Gardner's Amended Plat, Exhibit B. Member Johnson seconded the motion. All were in favor, motion carried. Rod & Susan Gardner; R&S Properties — Conditional Use Permit Public Hearing: Chairman Garren reminded everyone of the public hearing process and asked Mr. Gardner to explain the application. Rod Gardner of 2727 N Foothill Rd explained that they were applying for a CUP to allow two patio homes (one on each lot) in an R-T Zone located at 5122 Owens Ave. Chairman Garren opened the public portion of the hearing; those in favor, none; neutral, none; opposed, none. Chairman Garren closed the public portion of the hearing and opened discussion to P&Z Members. Member Lovinus reiterated the water lines running in one trench and sewer lines running in one trench along the opposite sides of the property and still meeting the 8' side yard requirement. Chairman Garren confirmed these were now 1/4 acre lots but still met the requirements for the R- T Zone, Conditional Use for a Patio Home. Member Lindsay moved to recommend to Council to approve Rod & Susan Gardner's CUP Application, Exhibit "C." Member Lovinus seconded the motion. All were in favor, motion carried. Area of Impact Agreement Update: Chairman Garren spoke with Steve Serr of Bonneville County. Mr. Serr is looking at the City's proposal regarding the verbiage changes in the Impact Area Agreement. Chairman Garren will touch base with him again next week if he has not heard back from him. If everything is okay it can be added to Bonneville County's Planning & Zoning Agenda. PILC Engineers a land Surveyors City of Iona ONFrom: Paul Scoresby <pscoresby@schiesseng.com> Sent: Friday, May 08, 2015 5:13 PM To: Julie Hammond Subject: Gardner Lot Split/Short Plat Attachments: ibsd map.pdf Julie, After review of the utilities, water and sewer, it remains uncertain whether the back lot can be served sewer from a short existing extension of the IBSD sewer line in Walker St. that extends east from the intersection of Olson Ave. The attached IBSD map shows the sewer as perhaps smaller than 8", which renders it unusable as a line that could be hooked up too. The manhole location is also estimated. Standard minimum size sewer line is 8". If the line is proven to be smaller than this, then either the mainline should be rebuilt to 8" line size or the service line should be extended to Olson St. These are both difficult options. All of this work would have to be done under the purview of IBSD. The other alternative would be to run the sewer line for the back lot on one side of the house on the front lot. The plat would then require a sewer utility easement along one side of the front lot for the sewer service line coming from the back lot. The sewer service line for the front lot could be placed in the same trench for the sewer service from the back lot. The homes may need to be a little narrower than shown to accommodate this arrangement. The city waterline in Walker St. is a service line that cannot be shared as a service line for the back lot. Water service will most likely have to come from Olson St. for the back lot. But this should be problematic for the city due to all of the new asphalt in place. Again, it may be easier to serve the back lot water from Iona Rd. A water utility easement through the front lot for the water service line from the back lot would be needed. The waterline for the back lot could share the same trench as the water service line for the front lot. The water service lines should be on opposite sides of the house and lot from the sewer service lines to honor separation requirements of water and sewer. This comes from the Idaho Drinking Water Rules. The homes may need to be a little narrower than shown to accommodate this arrangement. Regarding water rights release from Progressive Irrigation. It seems easier here to let the property opt out of Progressive Irrigation due to its location and difficulty of available water delivery. But in discussions with Zech, the City may not want to give an irrigation water rights release to the property. It is in the best interests of the city to try to capture the Progressive Irrigation water rights from property like this for later uses such as irrigation of additional park space that currently does not have surface water rights or for mitigation for future water rights. This whole issue should be explored more with Progressive Irrigation District and policy set forth that gives clear guidance on the disposition of surface irrigation water with any kind of plat. The proposed buildings on each lot do not leave much side yard set back to property line. These and other distances should be verified against the ordinance for compliance. The current zoning is RT. 4. We have a proposed plat for this property; it is split into 2 properties. We proposed that we build a Patio Home on each of the said properties. One accessing the property from Owens Avenue and one accessing from Walker Avenue. One lot will be approximately 10,498 square feet and other lot is approximately 10,585 square feet; this exceeds the minimum requirements of 6500 square feet.
