Home My Public Portal About004-2002 - Vacation 2423 - 2501 Richwood Dr ORDINANCE NO- 4 - 2002 A SPECIAL ORDINANCE VACATING AN UNUSED PORTION OF LAND LOCATED AT 2423 RICHWOOD RIVE TO THE EAST AND 2501 RICHWOOD DRIVE TO THE WEST WHEREAS, Mr. Charles R. Fitzgerald has petitioned Common Council of Richmond, Indiana requesting the vacation of an unused portion of land located at 2423 Richwood Drive to the east and 2501 Richwood Drive to the west; and WHEREAS, other than the petitioner, Evelyn Sherrow and the City of Richmond are the only adjoining property owners; and WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing ion said petition February 4, 2002, after publishing legal notice thereof at least ten (10) days in advance of said hearing as required by statute; and WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond code 155.04(b), conducted a pubic hearing on said petition January 24, 2002, after publishing legal notice thereof at least ten (19) days in advance of said hearing as required by ordinance; and WHEREAS, it is desirable to vacate said portion of roadway. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the portion of pubic way described below is hereby vacated and Mr. Charles R.
