HomeMy Public PortalAboutR0004 R E S O L U T I O N NO. 4 PROCEDURE FOR APPLICANTS WHERE TRUNK SEWERS ARE NOT PRESENTLY AVAILABLE 1. If, upon examination, it is found that the applicant has available sufficient funds to construct a trunk or trunk sewers of a size and capacity adequate for the maximum anticipated needs of the area to be served, the District will enter into an agreement with the applicant substantially in the form attached and marked "Form 1." 2. If it appears that the applicant's presently available funds are insufficient to construct a trunk or trunk sewers of a size and capacity adequate for the maximum anticipated needs of the service area, the District will enter into an agreement with the applicant substantially in the form attached and marked "Form 2." Prior to the determination of the form of agreement to be used in the specific case for which an application is received, the Executive Director or the person or agency designated by him shall: 1.Require the filing of a subdivision plat with the District, together with sanitary sewage plans for such subdivision and an estimate of the cost thereof prepared by a competent engineer. 2. Examine such plat and make a determination of: (a)the subdistrict in which the tract should be included; (b)the probable point or points of connection to the existing sewer system of the District; (c)the sufficiency of said plans as to size and capacity of sewers and design for the installation and if found satisfactory and of sufficient size and capacity for the maximum anticipated needs of the service area, approve the same or require their revision to meet such standards; (d)examine and approve the estimate of probable cost or cause the same to be revised. 3. Notify applicant of his findings under 2. 4.Ascertain by consultation with applicant whether contract Form 1 or Contract Form 2 is best suited to applicant's needs. 5. If Form 1 is used, no other instrument is necessary. 6. If Form 2 is used: (a)require applicant to have prepared a declaration of trust giving the trustee powers necessary to perform functions required by Form 2; (b)submit declaration of trust to District for approval; (c)agree with trustees under declaration of trust on depository; (d)file with depository copy of agreement, and deposit funds as funds are paid in upon the issuance of building permits. The above Resolution was adopted June 7, 1954.
