HomeMy Public PortalAboutR0091REPEALED BY RESOLUTION NO. 244 -7/2/59 REPEALS NO. 79 R E S O L U T I O N NO. 91 WHEREAS, the Board of Trustees has received a petition from property owners on a portion of Waddell Avenue in the City of St. Louis, not included in any subdistrict for the construction of sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is now served by septic tanks, which are inefficient in such a congested area, and the effluent of which creates a nuisance in said area and the surrounding territory; and WHEREAS, it has been estimated that the probable cost of the installation of such sewers will be $8,000.00, and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the real property included in such area; WHEREAS, by Resolution No. 79, adopted August 13, 1956, Special Benefit Subdistrict No. 15 of the District was created but no notice of hearing was given and no hearing held pursuant thereto; NOW, THEREFORE, BE IT RESOLVED, that Resolution No. 79 is hereby repealed; and BE IT FURTHER RESOLVED that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 15 of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing sewers in a portion 2 of Waddell Avenue in the City of St. Louis, Missouri, said subdistrict to be described as follows; Beginning at the point of intersection of the eastern line of Carondelet Boulevard, irregular in width, and the eastward prolongation of the center line of Weber Road Cut-Off, sixty (60') feet wide; thence in a westerly direction along the said prolongation of the center line of Weber Road Cut-Off and the said centerline to its point of intersection with the City Limits Line of 1876 in Weber Road; thence in a northwesterly direction along the said City Limits Line to its point of intersection with a line erected perpendicularly from the northeastern line of an unnamed Road, thirty and forty-six one-hundredths feet (30.46') wide and approximately parallel with Poepping Street, said perpendicular line, as measured along the said northeastern line, being three hundred sixty-five feet (365') southeastwardly from the southeastern line of Waddell Avenue, fifty feet (50') wide; thence in a northeasterly direction along the said perpendicular line and its prolongation northeastwardly to the point of its intersection with a line northeastward of and parallel with and one hundred fifty (150') perpendicularly distant from the northeastern line of the aforesaid unnamed Road; thence in a southeasterly direction along the said parallel line to the point of its intersection with the east line of Block One of Waddell's Addition; thence 3 in a northeasterly direction along the said east line of Block One, a distance of one hundred eighty-one and six one- hundredths feet (181.06'), more or less, to the point of its intersection with the former block line between City Block 3289 and that part of the former City Block 3172 now a part of City Block 3289, and which is also the prolongation northwestwardly of the southwestern line of Carondelet Boulevard; thence in a southeasterly direction along the said prolongation for a distance of thirty-three and sixty one- hundredths feet (33.60'), more or less, to the point of its intersection with the western line of Carondelet Boulevard; thence in a northerly direction along the said western line of Carondelet Boulevard to the point of its intersection with the southwestern line of Poepping Street, fifty feet (50') wide; thence in a southeasterly direction along the prolongation of the said southwestern line of Poepping Street to the point of its intersection with the eastern line of Carondelet Boulevard; and thence in a southerly direction along the said eastern line of Carondelet Boulevard to the point of beginning. Such sewers to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit assess- ments be levied against all real property within the boundaries hereinbefore delineated in the proportion that the area each 4 parcel of real property bears to the entire area exclusive of public roads, streets, and alleys within the boundaries of the special benefit subdistrict; and BE IT FURTHER RESOLVED that a public hearing be held in said Special Benefit Subdistrict No. 15 at such time and place as the Executive Director shall determine, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed special benefit subdistrict, and by the distribution of hand bills among the residents in such benefit subdistrict, for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made. 5 The foregoing Resolution was adopted September 24, 1956.
