WHEREAS, the Board of Trustees has received a petition
from property owners in an area which includes Manchester and
Lockett Avenues, in the City of Des Peres, St. Louis County,
Missouri, not included in any subdistrict for the construction of
lateral sewers to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is presently
served by septic tanks, which are inefficient, and the effluent of
which creates a nuisance in said area and the surrounding
territory; and
WHEREAS, it has been estimated that the probable cost
of the installation of such lateral sewers will be Three Thousand
Three Hundred ($3,300.00) Dollars, and that the most practicable
method of payment therefor is by special tax bills, or other
evidence of special benefit assessments upon the real property
included in such area;
NOW, THEREFORE, BE IT RESOLVED, that the construction
of sanitary sewers in said area is necessary in order to protect
the health of the residents therein, that such sewers shall be
lateral sanitary sewers available to each parcel of property in
the area; that the estimated cost of constructing such lateral
sewers is Three Thousand, Three Hundred ($3,300.00) Dollars; that
such costs shall be paid for by special ax bills or other evidence
of special benefit assessments upon the real property in the area;
and that such lateral sewers be constructed on Manchester and
Lockett Avenues for the area described as follows:
A parcel of land in the County of St. Louis, State of

Missouri, in the east half of the northwest quarter of
Section 35 Township 45 north, Range 5 east. Beginning
at a point a distance of 1089 feet south of north line
of said Section 35 and 782 feet, more or less west of
the east line of the northwest quarter of said Section
35 said point being the northwest corner of property
now or formerly owned by Harold H. Ahner and Shirley M.
Ahner, his wife, and recorded in Book 2474, page 28,
St. Louis County Records; thence southwardly 88 degrees
40 minutes east 295.31 feet more or less to an iron
pipe said pipe being the northeast corner of property
now or formerly owned by Harold H. Ahner and Shirley M.
Ahner his wife and Herbert F. Ahner and Dorothy M.
Ahner his wife recorded in Book 2327 page 74 St. Louis
County Records; thence southwardly 4 degrees 42 minutes
west 20 feet to a point said point being the
northwesternmost corner of property now or formerly
owned by Walter C. Stern and Renate K. Stern his wife
recorded in Book 2570 page 489, St. Louis County
Records; thence southwardly 88 degrees 40 minutes east
110 feet to a point said point being the
northeasternmost corner of property now or formerly
owned by Walter C. Stern and Renate K. Stern his wife
recorded in Book 2570 page 489, St. Louis County
Records; thence southwardly 7 degrees 5 minutes west
282.71 feet to a point in the north line of Manchester
Road, Mo. State Highway 100, said point being the

southeasternmost corner of property now or formerly
owned by Walter C. and Renate K. Stern thence north 73
degrees 51 minutes west 338.52 feet to a pipe in the
north line of Manchester Road, Mo. State Highway 100,
and in east line of a 20 foot Private Road said iron
pipe being the southwesternmost corner of property now
or formerly owned by Miller Shantz and Emma Shantz his
wife recorded in Book 1776 page 136 St. Louis County
Records; thence north 10 degrees 46 minutes west a
distance 213 feet more or less, to the point of
beginning.
which said area shall be and the same is hereby designated Special
Benefit Subdistrict No. 20 and such sewers therein to be connected
to existing sanitary sewer of The Metropolitan St. Louis Sewer
District and;
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all real property within the
boundaries hereinbefore delineated in the proportion that the area
each parcel of real property bears to the entire area within the
boundaries of the special benefit subdistrict; exclusive of public
streets, roads, and alleys; and
BE IT FURTHER RESOLVED, that a public hearing be held
in the Proposed Special Benefit Subdistrict No. 20 at such time
and place as the Executive Director shall determine, and that
notice of such hearing be given by the posting of notices in not
less than three public places within the boundaries of the
proposed benefit subdistrict; and by the distribution of hand

bills among the residents of such benefit subdistrict, for the
purpose of determining whether or not it is in the public interest
that such improvement, or any part thereof, be made.
