HomeMy Public PortalAboutR0114 R E S O L U T I O N NO. 114 WHEREAS, the Board of Trustees has received a petition from property owners in an area which includes portions of the City of St. Ann, Villages of Mary Ridge and Breckenridge Hills, St. Louis County, Missouri, not included in any subdistrict for the construction of sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is now served by septic tanks, which are inefficient in such a congested area, and the effluent of which creates a nuisance in said area and the surrounding territory; and WHEREAS, it has been estimated that the probable cost of the installation of such sewers will be $200,000.00, and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the real property benefited by such improvement; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that a special benefit subdistrict to be known as Charjean Drive, Special Benefit Subdistrict No. 26 of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing lateral sanitary sewers in a portion of the City of St. Ann and the Villages of Mary Ridge and Breckenridge Hills in St. Louis County, Missouri, to be described as follows: Beginning at the intersection of the north line of Baltimore Avenue and the east line of Wismer Road as shown on the plat 2 of Central Overland Park as recorded in Plat Book 12, Page 132 of the St. Louis County Records, thence west along the north line of Baltimore Avenue to its intersection with the direct prolongation northwardly of the east line of Lot 6 of Block 3 of East Ashby as shown on the plat of East Ashby as recorded in Plat Book 8, Page 17 of the St. Louis County Records; thence south along the last mentioned prolongation and along the east line of Lots 6 and 7 of Block 3 of East Ashby to the southeast corner of Lot 7 of Block 3 of East Ashby; thence west along the south line of said Lot 7 and its direct prolongation westwardly to the west line of Marion Sims Avenue as shown on the plat of East Ashby; thence south along the west line of Marion Sims Avenue as shown on the plat of North Ashby as recorded in Plat Book 9, Page 54 of the St. Louis County Records to the northeast corner of the property deeded to Wm. A. and Dolly M. Schneider as recorded in Book 2294, Page 325 of the St. Louis County Records; thence west along the north line of said property deeded to Wm. A. and Dolly M. Schneider to the northwest corner of said property; thence south along the west line of said Schneider property and along the west line of the property deeded to Joseph F. and Norine Leonard as recorded in Book 2923, Page 313 of the St. Louis County Records to the southwest corner of said Leonard property; thence east along the south line of said Leonard property to the west line of Marion Sims Avenue 3 as shown on the plat of North Ashby; thence south along the west line of Marion Sims Avenue to the northeast corner of Lot 3 of Block 1 of East Ashby; thence west along the south line of Emerson Avenue as shown on the plat of East Ashby to the Northwest corner of said Lot 3 of Block 1 of East Ashby; thence south along the east line of Lots 4 and 5 of Block 1 of East Ashby to the southeast corner of the property deeded to Erwin H., Jr. and Rosemary L. Weisz as recorded in Book 2926, Page 614 of the St. Louis County Records; thence west along the south line of said Weisz property and its direct prolongation westwardly to the west line of Chaucer Avenue as shown on the plat of Sutherlands' Addition to Ashby Place as recorded in Plat Book 10, Page 63 of the St. Louis County Records; thence north along the west line of Chaucer Avenue to the northeast corner of Lot 2 of Poe Ridge as shown on the plat of Poe Ridge as recorded in Plat Book 17, Page 68 of the St. Louis County Records; thence west along the north line of Lot 2 of Poe Ridge to the southwest corner of Lot 3 of Poe Ridge; thence north along the west line of Lot 3 of Poe Ridge and along the west line of Lots 12 and 13 of North Ashby to the south line of Carlyle Avenue as shown on the plat of North Ashby; thence west along the south line of Carlyle Avenue as shown on the plat of Gocke Terrace Plat No. 2 as recorded in Plat Book 72, Page 5 of the St. Louis County Records to its intersection with the direct prolongation 4 southwardly of the east line of Lot 68 of Gocke Terrace Plat No. 2; thence north along the last mentioned prolongation and along the east line of Lots 50 and 51 of Gocke Terrace Plat No. 1 as shown on the plat of Gocke Terrace Plat No. 1 as recorded in Plat Book 68, Page 10 of the St. Louis County Records to the southwest corner of Lot 149 of Gocke Terrace Plat No. 4 as shown on the plat of Gocke Terrace "Plat No. 4 as recorded in Plat Book 74, Page 42 of the St Louis County Records, thence east along the south line of Lots 149 and 150 of Gocke Terrace Plat No. 4 to the southeast corner of said Lot 150; thence north along the east line of said Lot 150 and its direct prolongation northwardly to the north line of Baltimore Avenue as shown on the plat of Gocke Terrace Plat No. 4; thence west along the north line of Baltimore Avenue to the southeast corner of Lot 11 of St. Ann's Heights Addition as shown on the plat of St. Ann's Addition as recorded in Plat Book 70, Page 22 of the St. Louis County Records; thence north along the east line of said Lot 11 of St. Ann's Heights Addition and along the east line of Lots 33 through 17 inclusive of St. Ann's Heights as shown on the plat of St. Ann's Heights as recorded in Plat Book 50, Page 47 of the St. Louis County Records and its direct prolongation northwardly to the north line of Breckenridge Avenue as shown on the plat of Buder Park Terrace as recorded in Plat Book 48, Page 31 of the St. Louis County Records; 5 thence east along the north line of Breckenridge Avenue to its intersection with the east line of Buder Park Terrace as shown on the plat of Buder Park Terrace; thence northwardly along the east line of Buder Park Terrace to the southwest corner of Out Lot 1 of Buder Park Terrace; thence north along the west line of Out Lots 1 and 2 of Buder Park Terrace to the northwest corner of said Out Lot 2; thence east along the north line of Out Lot 2 of Buder Park Terrace to the northwest corner of Lot 60 of East Ashby No. 2 as shown on the plat of East Ashby No. 2 as recorded in Plat Book 13, Page 70 of the St. Louis County Records; thence northwardly to the southwest corner of Lot 69 of Mary Ridge as shown on the plat of Mary Ridge as recorded in Plat Book 37, Page 8 of the St. Louis County Records; thence east along the south line of said Lot 69 to the southeast corner of said Lot 69; thence northeast along the southeast line of said Lot 69 to the easternmost corner of the property deeded to Robert J. and Betty A. Vogt as recorded in Book 3167, Page 3 of the St. Louis County Records; thence west along the south line of said Vogt property and its direct prolongation westwardly to the west line of Tennyson Avenue as shown on the plat of Central Overland Park; thence south along the west line of Tennyson Avenue to northeast corner of the property deeded to John and Leocadia Barylski as recorded in Book 523, Page 178 of the St. Louis County Records; thence west along the north line of said John and Leocadia Barylski property to the northwest corner of said property; thence south along the west line of said John and Leocadia Barylski property and its prolongation to its intersection with the north line of Baltimore Avenue; thence westwardly along the north line of Baltimore Avenue to the point of beginning. Such sewers to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all real property which shall be found to be benefited by the said construction in the proportion 9 that the area each such parcel of real property bears to the entire benefited area exclusive of public streets, roads and alleys within the said benefited area; and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 26 at such time and place as the Executive Director shall determine, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed Special Benefit Subdistrict and by the distribution of hand bills among the residents in such benefit subdistrict, for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made. 10 The foregoing Resolution was adopted March 18, 1957.
