HomeMy Public PortalAboutR0126 R E S O L U T I O N NO. 126 WHEREAS, the Board has received a petition from property owners in the area of Annex Court, Brand and Bermuda Avenues in the City of Normandy, St. Louis County, Missouri, not included in any subdistrict for the construction of sanitary sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sanitary sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such sanitary sewers will be $38,000.00 and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the real property which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 29 of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing sanitary sewers in the area of Annex Court, Brand and Bermuda Avenues in the City of Normandy, St. Louis County, Missouri, said subdistrict to be described as follows: Beginning at a point, said point being the southeast corner of Williamshaven Subdivision as recorded in Plat Book 60 on Page 35 of the St. Louis County Records; thence northwardly along the east line of said Williamshaven Subdivision to a point, said point being the southwest corner of Williamshaven Addition Subdivision as recorded in Plat Book 56 on Page 57 of the St. Louis County Records; thence eastwardly along the south line of said Williamshaven Addition Subdivision to the southeast corner of Lot 5 of said subdivision; thence northwardly along the east line of said Lot 5 across Brand Avenue (50' wide) and along the east line of Lot 4 of said Williamshaven Addition Subdivision to the north line of said subdivision; thence westwardly along the north line of said subdivision and said north line projected to its intersection with the east right of way line of the Wabash Railroad; thence northwardly along said east right of way line of said Wabash Railroad, across Woodstock Avenue (40' wide) to its intersection with the north line of a lot now or formerly owned by Jasper A. Monachella and Virginia E. Monachella, his wife, as recorded in Deed Book 2764 on Page 612 of the St. Louis County Records; thence eastwardly along the north line of said Monachella property and along the north line of a lot now or formerly owned by Jack L. Hamil and Jane E. Hamil, his wife, as recorded in Deed Book 3190 on Page 332 of the St. Louis County Records to the northeast corner of said Hamil property; thence southeastwardly in a straight line to a point, said point being the intersection of the east line of a lot now or formerly owned by Schmersahl Realty Company, Inc. as recorded in Deed Book 3704 on Page 565 of the St. Louis County Records and a line 200' north of and parallel to the north line of Woodstock Avenue (40' wide); thence eastwardly along said parallel line to the northeast corner of a lot now or formerly owned by Wilber B. Kern and Mary A. Kern, his wife, as recorded in Deed Book 2484 on Page 63 of the St. Louis County Records; thence southwardly along the east line of said Kern property to the northwest corner of a lot now or formerly owned by Lawrence S. Molina and Dorothy M. Molina, his wife, as recorded in Deed Book 3506 on Page 613 of the St. Louis County Records; thence eastwardly along the north line of said Molina property and said north line projected to the west line of Bermuda Avenue (40' wide, formerly Old Florissant); thence southwardly along said west line of Bermuda Avenue, across Woodstock Avenue, (40' wide), to the southeast corner of a lot now or formerly owned by Claus H. Brand, Sr. and Clara Brand, his wife, as recorded in Deed Book 1036 on Page 333 of the St. Louis County Records; thence southeastwardly across Bermuda Avenue to the northwest corner of a lot now or formerly owned by Robert E. Balch and Carrie Balch, his wife, as recorded in Deed Book 3213 on Page 24 of the St. Louis County Records; thence eastwardly along the north line of said Balch property to the northeast corner of said property; thence southwardly along the east line of said Balch property to the southeast corner of said property; thence southeastwardly in a straight line to the northeast corner of Lot 10 of Block 2 of North Hill Homesites Subdivision as recorded in Plat Book 19 on Page 43 of the St. Louis County Records; thence southeastwardly along the east lines of said Lot 10 and Lots 9 through 1 of said Block 2 of said North Hill Homesites Subdivision and across Blanding Avenue, formerly Berkley (60' wide) to the northeast corner of Lot 8 of Block 1 of said North Hill Homesites Subdivision; thence southeastwardly along the east lines of said Lot 8 and Lots 7 through 1 of said Block 1 of North Hill Homesites Subdivision to the north line of Castro Drive (40' wide) formerly Country Club Drive; thence southwardly across Castro Drive to a point in the south line of said Castro Drive, said point being 150' east of and measured perpendicular to the east line of Bermuda Avenue (40' wide); thence southwardly along a line 150' east of and parallel to the east line of said Bermuda Avenue to its intersection with the south line of a lot now or formerly owned by Harold H. Feller and Lillian M. Feller, his wife, as recorded in Deed Book 3633 on Page 483 of the St. Louis County Records; thence westwardly along the south line of said Feller property and said lines projected across Bermuda Avenue to the west line of said Bermuda Avenue; thence northwardly along the west line of said Bermuda Avenue to the northernmost corner of Norwood Manor Subdivision, Plat 1 as recorded in Plat Book 60 on Page 45 of the St. Louis County Records; thence southwestwardly along the northwest line of said Norwood Manor Subdivision to the point of beginning. Such sewers to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all real property which shall be 5 found to be benefitted by the said construction in the proportion that the area each such parcel of real property bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area; and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 29 at such time and place as the Executive Director shall determine, and that notice of such hearing be given by the posting of notices in not less than three public places and by the distribution of hand bills among the residents within the boundaries of the proposed special benefit subdistrict for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made. The foregoing Resolution was adopted July 10, 1957.
