HomeMy Public PortalAboutR0127 R E S O L U T I O N NO. 127 WHEREAS, the Board has received a petition from property owners on a portion of Dellwood Creek located in the area north and west of Halls Ferry and Chambers Roads in St Louis County, Missouri, not included in any subdistrict for the construction of sanitary subtrunk sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sanitary subtrunk sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such sanitary subtrunk sewers will be approximately $250,000.00 and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the real property which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 30 (Dellwood Creek) of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing sanitary subtrunk sewers in a portion of Dellwood Creek located in the area north and west of Halls Ferry and Chambers Roads in St Louis County, Missouri, said subdistrict to be described as follows: Beginning at the point of intersection of the centerline of Halls Ferry Road, 60 feet wide, with the eastern prolongation of the northern line of tract described in deed to Monark Petroleum Co. recorded in Book 3321, Page 277, St Louis County Recorder's Office (said point of beginning being 200 feet more or less, north of the northern line of Chambers Road, 40 feet wide); thence running westwardly 179 feet, more or less, along the eastern prolongation of and along the northern line of said Monark Petroleum Co. tract to its northwestern corner; thence northwardly and parallel with the western line of Halls Ferry Road to a point distant 400 feet northwardly from (measured at right angles to) the northern line of Chambers Road, 40 feet wide; thence westwardly and parallel with the northern line of Chambers Road, 40 feet wide, to the eastern line of Pepper Lane subdivision; thence southwardly along the eastern line of Pepper Lane subdivision to the northern line of Chambers Road, 40 feet wide; thence westwardly along the northern line of Chambers Road, 40 feet wide, to the western line of Pepper Lane subdivision produced southwardly; thence northwardly along the southern production of the western line of Pepper Lane subdivision, to its intersection with the eastern prolongation of the northern line of Lot 3 in Block 1 of Atwater Terrace subdivision; thence westwardly along said prolongation and along the northern line of said Lot 3 in Block 1 and along the northern line of Lot 11 in said Block 1 and continuing westwardly across Ventura Drive and along the northern line of Lot 3 in Block 3 of Atwater Terrace subdivision to the eastern line of Cloverdale Drive; thence southwardly along the eastern line of Cloverdale Drive to the southern line of said Lot 3 in Block 3; thence westwardly across Cloverdale drive and along the northern line of Lot 2 in Block 5 of Atwater Terrace subdivision to the northwestern corner of said Lot 2 in Block 5; thence southwardly along the western line of said Lot 2 in Block 5 to the southwestern corner of said Lot 2 in Block 5; thence westwardly along the northern line of Lot 9 in Block 5 of Atwater Terrace subdivision and continuing across Clearview Drive and along the northern lines of Lots 1 and 9 in Block 7 of Atwater Terrace subdivision to the eastern line of Winkler Drive; thence southwardly along the eastern line of Winkler Drive and its southern prolongation to the center of Chambers Road, 40 feet wide; thence westwardly along the center of Chambers Road, 40 feet wide to its intersection with the southern prolongation of the eastern line of Lot 2 in Block 4 of Chambers Park subdivision; thence northwardly along said prolongation and along the eastern line of said Lot 2 in Block 4 to its northeastern corner; thence westwardly along the northern line of Lots 2 and 1 in Block 4 of Chambers Park subdivision and continuing across Bon-Oak Drive and along the northern line of Lots 2 and 1 in Block 5 of Chambers Park subdivision to the western line of Chambers Park subdivision; Parnello, recorded in Book 2040, Page 410, St. Louis County Recorder's Office; thence leaving said Dellwood Hills subdivision and running westwardly along the northern line of said Parnello tract to a point 150 feet eastwardly from the eastern line of Florissant Avenue, 60 feet wide; thence northwardly and parallel with the eastern line of Florissant Avenue to the point of intersection with the eastern prolongation of the southern line of Ferguson Acres subdivision; thence westwardly along said prolongation and continuing across Florissant Avenue and along the southern line of said Ferguson Acres subdivision to the eastern line of Lot 9 in Ferguson Acres subdivision; thence thru Ferguson Acres subdivision northwardly along the eastern line of Lot 9 to the southern line of Kroeger Drive and continuing westwardly along the southern line of Kroeger Drive to the southern prolongation of the western line of Lot 35; thence northwardly along said prolongation across Kroeger Drive and along the western line of said Lot 35 to the most southern corner of Lot 36 and thence continuing northwestwardly along the southwestern lines of Lots 36 and 37 to the southwestern corner of Lot 37 and continuing northwardly along the western line of said Lot 37 to the southern line of Thatcher Avenue; thence northwardly across Thatcher Avenue to the southwestern corner of Lot 72 and continuing northwardly along the western line of Lot 72 to the southern line of Lot 91; thence continuing westwardly along the southern line of Lot 91 in Ferguson Acres subdivision to its southwestern corner; thence northwardly along the western line of said Lot 91 in Ferguson Acres to the southern line of Stein Road; thence westwardly along the southern line of Stein Road to its intersection with the southern prolongation of the eastern line of tract described in deed to Carl C. Such sewers to be connected to existing Black Jack Trunk Sewer. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all real property which shall be found to be benefitted by the said construction in the proportion that the area each such parcel of real property bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area, and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 30 at such time and place as the Executive Director shall determine, and that notice of such hearing be given by the posting of notices in not less than three public places and by the distribution of hand bills among the residents within the boundaries of the proposed special benefit subdistrict for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made. 12 The foregoing Resolution was adopted July 1, 1957.
