WHEREAS, the Board has received a petition from
property owners in the area of Dyer Avenue and Page Boulevard in
the City of Overland in St. Louis County, Mo., not included in any
subdistrict for the construction of lateral sanitary sewers to
serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by sewers; and
WHEREAS, it has been estimated that the probable cost
of the installation of such lateral sanitary sewers will be
approximately Ninety-Two Thousand Dollars ($92,000.00), and that
the most practicable method of payment therefor is by special tax
bills, or other evidence of special benefit assessments upon the
real property which shall be found to be benefitted by such
improvement;
NOW, THEREFORE, BE IT RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 37
(East Iveland Lateral) of The Metropolitan St. Louis Sewer
District be and the same is hereby created for the purpose of
constructing lateral sanitary sewers in the area of Dyer Avenue
and Page Boulevard in the City of Overland in St. Louis County,
Mo., said subdistrict to be described as follows:
Beginning at a point of intersection of the centerline of
Page Boulevard and the southward prolongation of the east
boundary line of Ross Mason Subdivision as recorded in Plat
Book 17 on Page 88 in the St. Louis County Recorder of Deeds
Office; thence northwardly along said prolongation of said
east line of said Ross Mason Subdivision and along said east
line to the southeast corner of Lot 1 of said subdivision;
thence westwardly along the south line of said Lot 1 and said
line produced to its intersection with the centerline of
Morven Avenue; thence northwardly along the centerline of
Morven Avenue to its intersection with the centerline of Oak
Avenue; thence eastwardly along said centerline of Oak Avenue
to its intersection with the southward prolongation of the
east line of Lot 26 of Forest View Subdivision as recorded in
Plat Book 12 on Page 145 in the St. Louis County Recorder of
Deeds Office; thence northwardly along said prolongation and
along said east line of said Lot 26 to the northeast corner
of said Lot 26; thence westwardly along the north line of
said Lot 26 and along the north line of Lots 27 and 28 of
said Forest View Subdivision and said line produced to its
intersection with the centerline of Lake Avenue; thence
northwardly along the centerline of Lake Avenue to its
intersection with the westward prolongation of the north line
of Lots 12 through 9 of said Forest View Subdivision; thence
eastwardly along said prolongation and along the last
described line and its eastward prolongation to its
intersection with the centerline of Fairview Avenue; thence
northwardly along said centerline of said Fairview Avenue to
its intersection with the westward prolongation of the north
line of Lot 135 of said Forest View Subdivision; thence
eastwardly along said prolongation and along the last
described line and along said line produced eastwardly across
Korando Avenue along the north lines of Lots 104 and 97 of
said Forest View Subdivision to its intersection with the
centerline of Uceyle Avenue; thence southwardly along said
centerline of Uceyle Avenue to its intersection with the
centerline of Oak Avenue; thence eastwardly along said
centerline of Oak Avenue to its intersection with the
northward prolongation of the west line of Lot 67 of Iveland
Subdivision as recorded in Plat Book 21 on Page 21 in the St.
Louis County Recorder of Deeds Office; thence southwardly
along said prolongation and along said west line to the
southwest corner of said Lot 67; thence eastwardly along the
south line of said Lot 67 and said line produced to its
intersection with the centerline of O'Connell Avenue; thence
northwardly along said centerline of O'Connell Avenue to the
centerline of Oak Avenue; thence eastwardly along said
centerline of Oak Avenue to its intersection with the
southward prolongation of the west line of Lots 30 through 35
of said Iveland Subdivision; thence northwardly along said
prolongation and along said west line to the northwest corner
of said Lot 35; thence eastwardly along the north line of
said Lot 35 and said north line produced eastwardly across
Dyer Avenue and along the north line of Lot 4 of said Iveland
Subdivision to the northeast corner of said Lot 4, said
corner falling also on the eastern boundary line of the
Iveland Subdivision; thence southwardly along said eastern
boundary line and said line produced to its intersection with
the centerline of Page Boulevard; thence westwardly along the
centerline of Page Boulevard to the point of beginning.
Such sewers to be connected to a trunk sewer now owned
by the River des Peres Sanitary Trunk Sewer Extension Association,
which trunk sewer will be dedicated to The Metropolitan St. Louis
Sewer District.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all real property which shall be
found to be benefitted by the said construction in the proportion
that the area each such parcel of real property bears to the
entire benefitted area exclusive of public streets, roads and
alleys within the said benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held
within said Special Benefit Subdistrict No. 37 at such time and
place as the Executive Director shall determine, and that notice
of such hearing be given by the posting of notices in not less
than three public places and by the distribution of hand bills
among the residents within the boundaries of the proposed special
benefit subdistrict for the purpose of determining whether or not
it is in the public interest that such improvement, or any part
thereof, be made. The foregoing Resolution was adopted August 26, 1957.
