HomeMy Public PortalAboutR0145 R E S O L U T I O N NO. 145 WHEREAS, the Board has received a petition from property owners in the area of Lilian Avenue in the City of Des Peres, St. Louis County, Missouri, not included in any subdistrict for the construction of lateral sanitary sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such lateral sanitary sewers will be approximately Nine Thousand Five Hundred Dollars ($9,500.00), and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the real property which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 38 (Lilian Avenue) of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing lateral sanitary sewers in the area of Lilian Avenue in the City of Des Peres, St. Louis County, Missouri, said subdistrict to be described as follows: Beginning at a point, said point being the northeast corner of Lot 22 in Block 13 of Manhattan Heights Subdivision as recorded in Plat Book 19 on Page 41 of the St. Louis County Records; thence westwardly along the north line of Lots 22 thru 42 of said Block 13 and said north line produced westwardly across Tallie Drive (40 feet wide) to the northeast corner of Lot 19 in Block 5 of said subdivision; thence westwardly along the north line of Lots 19 thru 24 to the northeast corner of Lot 25 of said Block 5; thence southwardly along the east line of said Lot 25 to the southeast corner of said Lot 25; thence southeastwardly in a straight line across Lilian Avenue (40 feet wide) to the northeast corner of Lot 24 in Block 14 of said Manhattan Heights Subdivision; thence southwardly along the east line of said Lot 24 to the southeast corner of said Lot 24; thence eastwardly along the south line of Lots 25 thru 48 in said Block 14 to the southeast corner of said Lot 48; thence northwardly along the east line of said Lot 48 and the northern prolongation of said east line to the centerline of Lilian Avenue; thence eastwardly along said centerline of Lilian Avenue to its intersection with the west line of Marcia Lane (20 feet wide); thence northwardly along said west line of Marcia Lane to the point of beginning. Such sewers to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all real property which shall be found to be benefitted by the said construction in the proportion that the area each such parcel of real property bears to the entire benefitted area exclusive of public streets, roads and 3 alleys within the said benefitted area; and 4 BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 38 (Lilian Avenue) at such time and place as the Executive Director shall determine, and that notice of such hearing be given by the posting of notices in not less than three public places and by the distribution of handbills among the residents within the boundaries of the proposed special benefit subdistrict for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made. Such notice shall include a statement that special tax bills may be made payable in annual installments, not exceeding ten, provided the written request of the property owner so to pay is in the hands of the Director of Finance on or before the date the construction of said improvement shall have been completed. The foregoing Resolution was adopted September 23, 1957.
