WHEREAS, the Board has received a petition from
property owners in the area of North and South Road in the City of
Vinita Park, St. Louis County, Missouri, for the construction of
sanitary subtrunk sewers to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by sewers; and
WHEREAS, it has been estimated that the probable cost
of the installation of such sanitary trunk sewers will be
approximately Seventeen Thousand Dollars ($17,000.00), and that
the most practicable method of payment therefor is by special tax
bills, or other evidence of special benefit assessments upon the
real property which shall be found to be benefitted by such
improvement;
NOW, THEREFORE, BE IT RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 39 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing sanitary trunk
sewers in the area of North and South Road in the City of Vinita
Park, St. Louis County, Missouri, said subdistrict to be described
as follows:
Beginning at the intersection of the northeast line of the
abandoned right-of-way of the Creve Coeur line of the St.
Louis Public Service Company, 50 feet wide, and the eastward
prolongation of the south line of Lot 14, Block 10 of Vinita
Park Subdivision as recorded in Plat Book 7 on Page 32 in the
St. Louis County Recorder of Deeds office; thence westwardly
along said eastward prolongation and along said south line of
said Lot 14 and continuing westwardly along the south line of
Lots 13 through 3 of said Block 10 of said Vinita Park
Subdivision and said south line produced westwardly to its
intersection with the centerline of North and South Road (50
feet wide); thence southwardly along the centerline of North
and South Road to its intersection with the centerline of
Madison Avenue, a public street 50 feet wide; thence
westwardly along the centerline of Madison Avenue to its
intersection with the east line of Wolter Avenue an
unimproved street 25 feet wide; thence southwardly along the
east line of Wolter Avenue, 25 feet wide, to its intersection
with the prolongation eastwardly of the south line of
property now or formerly owned by the Merchants Refrigerating
Company as recorded in Deed Book 3371 on Page 297 in the St.
Louis County Recorder of Deeds office; thence westwardly a
distance of 188.0 feet along said prolongation and along said
south line of said Merchants Refrigerating Company property
to a point; thence northwestwardly a distance of 783.55 feet
to a point in the west line of said Merchants Refrigerating
Company property, said point being 984.72 feet from the north
line of said property of Merchants Refrigerating Company
measured along said west line of said property now or
formerly owned by Merchants Refrigerating Company; thence
continued northwestwardly in a straight line a distance of
212.0 feet to a point on the line making an angle of 48
degrees 31 minutes with the west line of said property now or
formerly owned by Merchants Refrigerating Company; thence
northwardly a distance of 723.43 feet to a point on a line
making an angle of 53 degrees 22 minutes with the
prolongation northwestwardly of the immediately before
described line; thence northwestwardly in a straight line a
distance of 156.00 feet to a point in the prolongation
westwardly of the north line of said property now or formerly
owned by the Merchants Refrigerating Company, said point also
being 192.0 feet west of the northwest corner of the
Merchants Refrigerating Company property measured along the
prolongation westwardly of the north line of the Merchants
Refrigerating Company property; thence continuing
northwestwardly in a straight line a distance of
approximately 453 feet to a point on the line making an angle
of 52 degrees 15 minutes with the prolongation westwardly of
the north line of the Merchants Refrigerating Company
property; thence northwardly a distance of 718.0 feet to a
point in the south line of property now or formerly owned by
Midwalt Development Corporation, as recorded in Deed Book
3582 on Page 341 of the St. Louis County Records, said line
718.0 feet in length being at right angles (90 degrees 00
minutes) to the south line of said Midwalt Development
Corporation property, also said point in the south line of
Midwalt Development Corporation property being 860 feet
measured along the said south line of Midwalt Development
Corporation property from the intersection of the east line
of the 100 foot wide right-of-way of the St. Louis Belt and
Terminal Railway with the south line of Midwalt Development
Corporation property; thence northwestwardly a distance of
645.79 feet to a point, said point being on a line making an
angle of 74 degrees 52 minutes 50 seconds with the south line
of said Midwalt Development Corporation property; thence in a
northeasterly direction 802.0 feet to a point on the south
line of Lot 1 of Central Addition to Midland Heights
Subdivision as recorded in Plat Book 5 on Page 79 in the St.
Louis County Recorder of Deeds office, said point being 218.0
feet west of the intersection of said south line of Central
Addition to Midland Heights with the southerly line of the
southerly strip of Midland Boulevard, a public street, said
southerly strip being 25 feet wide; thence eastwardly along
said south line of said Lot 1 to its intersection with the
southerly line of the southerly strip of said Midland
Boulevard; thence northeastwardly a distance of 75 feet more
or less to the northerly line of the 50 foot wide abandoned
right-of-way of the Creve Coeur line of the St. Louis Public
Service Company; thence southeastwardly and southwardly along
the northeast and eastern lines respectively of said
abandoned right-of-way to the point of beginning.
Such sewers to be connected with a certain existing
public sewer of The Metropolitan St. Louis Sewer District.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all real property which shall be

found to be benefitted by the said construction in the proportion
that the area each such parcel of real property bears to the
entire benefitted area exclusive of public streets, roads and
alleys within the said benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held
within said Special Benefit Subdistrict No. 39 at such time and
place as the Executive Director shall determine, and that notice
of such hearing be given by the posting of notices in not less
than three public places within the boundaries of the proposed
special benefit subdistrict for the purpose of determining whether
or not it is in the public interest that such improvement, or any
part thereof, be made.
