WHEREAS, the District, by Resolutions Nos. 134 and 135
created Special Benefit Subdistricts No. 32 (Central Avenue) and
No. 33 (Wilshire Terrace and Central Avenue); and
WHEREAS, it has been found necessary to redescribe the
boundaries of the area therein contained; and
WHEREAS, the Board has received a petition from
property owners in the area of Wilshire Terrace and Central Avenue
in the City of Webster Groves, St. Louis County, Missouri, not
included in any subdistrict for the construction of trunk sanitary
sewers to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by sewers and the existing method of sewage disposal is a danger
to public health; and
WHEREAS, trunk sanitary sewers to serve such area must
be connected to a private system of sewers and sewage treatment
facilities; and
WHEREAS, it has been estimated that the probable cost
of the installation of such trunk sanitary sewers will be
approximately Five Thousand Dollars ($5,000.00), and that a fee of
Two Hundred Seventy-five Dollars ($275.00) per lot or parcel of
ground served must be paid for connection of such trunk sanitary
sewers to the private sewer system, and that the most practicable
method of payment therefor is by special tax bills, or other
evidence of special benefit assessments upon the real property
which shall be found to be benefitted by such improvement;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that Resolutions Nos.
134 and 135 be, and the same hereby are, repealed.
BE IT FURTHER RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 44 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing trunk sanitary
sewers in the area of Wilshire Terrace and Central Avenue in the
City of Webster Groves, St. Louis County, Missouri, said
subdistrict to be described as follows:
Beginning at a point, said point being the intersection of
the centerline of Rock Hill Road, 40' wide, and the southwest
prolongation of the northwest line of Block B of Reavis Place
Subdivision, as recorded in Plat Book 6 on Page 54 of the St.
Louis County Records; thence northwardly along said
centerline of Rock Hill Road to its intersection with the
eastern prolongation of the north line of Lot 3 of Maelln
Place Subdivision as recorded in Plat Book 22 on Page 94 of
the St. Louis County Records; thence westwardly along said
produced line and said north line of Lot 3 to the west line
of said Lot 3; thence southwardly along the west line of Lots
3, 4 and 8 to the westernmost corner of said Lot 8; thence
southwestwardly along the northwest lines of Lots 9, 10 and
11 of said Maelln Place Subdivision to the northwest corner
of said Lot 11; thence southwardly along the west line of
said Lot 11 and along the southern prolongation of said west

line of Lot 11 to its intersection with the western
prolongation of the south line of Big Bend Park Subdivision
as recorded in Plat Book 8, Page 135 of the St. Louis County
Records; thence eastwardly along the western prolongation of
said south line of Big Bend Park Subdivision and along said
south line to the southeast corner of Lot 20 of said Big Bend
Park Subdivision; thence southwardly along a line
perpendicular to the south line of Big Bend Park Subdivision
to a point in the north line of Webster Downs Addition as
recorded in Plat Book 54, Page 39 of the St. Louis County
Records; thence eastwardly along the north line of said
Webster Downs Addition and continuing along the north line of
Webster Downs as recorded in Plat Book 45, Page 31 of the St.
Louis County Records; and said north line produced to the
centerline of Rock Hill Road; thence southwardly along the
centerline of Rock Hill Road to its intersection with the
western prolongation of the southeast line of Wilshire
Terrace Subdivision as recorded in Plat Book 34 on Page 47 of
the St. Louis County Records; thence northeastwardly along
said produced line and along the southeast line of said
Wilshire Terrace Subdivision and along the southeast line of
Wilshire Terrace Addition Subdivision as recorded in Plat
Book 35 on Page 89 of the St. Louis County Records to the
easternmost corner of said Wilshire Terrace Addition
Subdivision; thence northwestwardly along the northeast line
of said subdivision to the northernmost corner of said

subdivision; thence southwestwardly along the northwest line
of said Wilshire Terrace Addition Subdivision to the
easternmost corner of Lot 7 of Block 3 in Shadyside Heights
Subdivision as recorded in Plat Book 2 on Page 92 of the St.
Louis County Records; thence northwestwardly along the
northeast line of said Lot 7 to the northernmost corner of
said Lot 7; thence northwestwardly in a straight line across
Central Avenue; 40' wide, to the easternmost corner of Lot 7
of Block 2 in said Shadyside Heights Subdivision; thence
northwestwardly along the northeast line of said Lot 7 of
Block 2 to the northernmost corner of said Lot 7; thence
southwestwardly along the northwest line of said Block 2 to
the easternmost corner of Lot 19 of Block C of Reavis Place
Subdivision; thence northwestwardly along the northeast line
of said Lot 19 to the northernmost corner of said Lot 19;
thence in a straight line across Reavis Avenue, 50' wide, to
the easternmost corner of Lot 14 of Block B of said Reavis
Place Subdivision; thence northwestwardly along the northeast
line of said Lot 14 to the northernmost corner of said Lot
14; thence southwestwardly along the northwest line of said
Block B of said Reavis Place Subdivision and along the
southwestern prolongation of said northwest line to the point
of beginning.
Such sewers to be connected with a certain existing
private sewer owned by Russell & Company.
BE IT FURTHER RESOLVED, that special benefit

assessments be levied against each lot or parcel of ground which
is connected to such trunk sanitary sever in payment of the fixed
fee for connection to said private sewer system and that special
benefit assessments for the entire cost of such sanitary trunk
sewer be levied against all land which shall be found to be
benefitted by the said construction in the proportion that the
area each such lot or parcel of real property bears to the entire
benefitted area, exclusive of public streets, roads and alleys
within the said benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held
within said Special Benefit Subdistrict No. 44 at such time and
place as the Executive Director shall determine, and that notice
of such hearing be given by the posting of notices in not less
than three public places and by the distribution of hand bills
among the residents within the boundaries of the proposed special
benefit subdistrict for the purpose of determining whether or not
it is in the public interest that such improvement, or any part
thereof, be made.
