WHEREAS, the Board has received a petition from
property owners in the area of Central Addition to Midland Heights
in the City of Vinita Park, St. Louis County, Missouri, for the
construction of sanitary trunk sewers to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by sewers; and
WHEREAS, it has been estimated that the probable cost
of the installation of such sanitary trunk sewers will be
approximately Thirty-eight Thousand Dollars ($38,000.00), and that
the most practicable method of payment therefor is by special tax
bills, or other evidence of special benefit assessments upon the
land which shall be found to be benefitted by such improvement;
NOW, THEREFORE, BE IT RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 46 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing sanitary trunk
sewers in the area of Central Addition to Midland Heights in the
City of Vinita Park, St. Louis County, Missouri, said subdistrict
to be described as follows:
Beginning at a point in the south line of property now or
formerly owned by Midwalt Development Corporation in United
States Survey 1920 as recorded in Deed Book 3582 on Page 341
of the St. Louis County Records said point being 860.0 feet
east of the intersection of said south line of said Midwalt
property and the easterly line of the 100-foot wide right-of-
way of the St. Louis Belt and Terminal Railroad Company;
thence northwestwardly a distance of 645.79 feet to a point
in a line making an angle of 74 degrees 52 minutes 50 seconds
with said south line of said Midwalt property; thence
northeastwardly a distance of 802 feet to a point in the
south line of Central Addition to Midland Heights Subdivision
as recorded in Plat Book 5 on Page 79 of the St. Louis County
Records, said point being 218.0 feet west of the intersection
of the southerly line of Central Addition to Midland Heights
with the southerly line of the southerly strip of Midland
Boulevard, a public street with said southerly strip being 25
feet wide; thence westwardly along the southerly line of said
25 foot wide southerly strip of Midland Boulevard a distance
of approximately 1980 feet to its intersection with the east
line of Walton Road, a public street 30 feet wide; thence
southwardly a distance of about 800 feet to a point in the
east line of Walton Road, a public street 30 feet wide, said
point being in a line at right angles to the centerline of
Walton Road and 30 feet east of a point in the west line of
Walton Road 30 feet wide, said point in the west line of
Walton Road being 205.39 feet north of the southeast corner
of a 20 acre tract at the southwest corner of Walton Road and
Midland Boulevard, said tract being owned now or formerly by
the Trustees of The Principia and described in Deed Book 645,
Page 29 in the Recorder's office in St. Louis County,
Missouri; thence westwardly a distance of 30 feet on said
line at right angles to the centerline of Walton Road to its
intersection with the west line of Walton Road 30 feet wide;
thence southwestwardly a distance of 233.0 feet to a point in
the south line of said 20 acre tract, said point being 107.59
feet west of the intersection of south line of said 20 acre
tract with the west line of Walton Road 30 feet wide; thence
continuing southwestwardly a distance of 430.0 feet to a
point along a line making an angle of 61 degrees 50 minutes
measured in the southwest quadrant with the south line of the
before-described 20 acre tract, being also the north line of
a 16.94 acre tract now or formerly owned by the Trustees of
The Principia and described in Deed Book 992, Page 238 in the
Recorder's Office in St. Louis County, Missouri; thence
southwardly a distance of 816.78 feet to a point in the south
line of the before-described 16.94 acre tract, said point
being 431.59 feet west of the intersection of the south line
of said 16.94 acre tract and the west line of Walton Road 30
feet wide running northwardly; thence continuing southwardly
a distance of 273.0 feet to a point in a line making an angle
of 80 degrees 30 minutes measured in the northeast quadrant,
with the south line of the before-described 16.94 acre tract,
being also the north line of a 26.9926 acre tract now or
formerly owned by the Trustees of The Principia and described
in Deed Book 1076, Page 454 in the Recorder's Office in St.
Louis County, Missouri; thence southeastwardly a distance of
277.0 feet to a point in a line making an angle of 28 degrees
30 minutes to the left of the prolongation southwardly of the
immediately before described line; thence eastwardly a
distance of 210.0 feet to a point on a line making an angle
of 57 degrees 30 minutes to the left of the prolongation
southeastwardly of the immediately before-described line;
thence southwardly a distance of 516 feet more or less to a
point in the south line of the before-described 26.9926 acre
tract, said point being 97.0 feet west of the intersection of
the south line of said 26.9926 acre tract and the west line
of Walton Road 30 feet wide; thence southeastwardly a
distance of 410 feet more or less to the intersection of the
west line of Walton Road 40 feet wide and the northwest line
of the 200 foot wide right-of-way of the St. Louis Belt and
Terminal Railroad; thence southeastwardly along a straight
line a distance of approximately 220 feet to the intersection
of the east line of Walton Road 40 feet wide with the east
line of a 100 foot wide right-of-way of the St. Louis Belt
and Terminal Railroad; said point being 542.69 feet north of
the southwest corner of property now or formerly owned by
Union Electric Company of Missouri, as recorded in Deed Book
2484 on Page 594 of the St. Louis County Records measured
along the east line of Walton Road 40 feet wide; thence
southeastwardly along a straight line a distance of 621.24
feet to the south line of said Union Electric Company
property; said point also being 300 feet east of the east
line of Walton Road 40 feet wide measured along the south
line of said Union Electric Company property; thence
eastwardly a distance of 400 feet more or less along said
south line to the northeast corner of property now or
formerly owned by Jim Paton, as recorded in Deed Book 3097 on
Page 411 of the St. Louis County Records; thence southwardly
a distance of 240 feet more or less along the east line of
said Jim Paton property to its intersection with the north
line of Page Avenue, a public street 100 feet wide; thence
eastwardly a distance of 396.19 feet along the north line of
Page Avenue to a point; thence along a straight line making
an angle of 62 degrees 35 minutes 20 seconds with the north
line of Page Avenue 100 feet wide measured in the northeast
quadrant, a distance of 732.61 feet to a point; thence in a
northeastwardly direction a distance of 795.0 feet along a
straight line to a point in the westward prolongation of the
north line of property now or formerly owned by Merchants
Refrigerating Company, as recorded in Deed Book 3371 on Page
297 of the St. Louis County Records, said point being 418.0
feet west of the northwest corner of said Merchants
Refrigerating Company property; thence continuing
northeastwardly a distance of 200.70 feet along a line making
an angle of 64 degrees 50 minutes (measured in the northeast
quadrant) with the prolongation westwardly of the north line
of said Merchants Refrigerating Company property; thence
northwestwardly a distance of approximately 223 feet to a
point along a straight line making an angle of 117 degrees 05
minutes with the immediately before-described line measured
in the northwest and southwest quadrants; thence northwardly
a distance of 718.0 feet to the point of beginning.

Such sewers to be connected with a certain existing
public sewer of The Metropolitan St. Louis Sewer District.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all land which shall be found to be
benefitted by the said construction in the proportion that the
area each such parcel of land bears to the entire benefitted area
exclusive of public streets, roads and alleys within the said
benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held
within said Special Benefit Subdistrict No. 46 at such time and
place as the Executive Director shall determine, for the purpose
of determining whether or not it is in the public interest that
such improvement or any part thereof be made, and that notice of
such public hearing be given by the posting of notices in not less
than three public places within the boundaries of the proposed
special benefit subdistrict.
