WHEREAS, the Board has received a petition from
property owners in the area of Deane Court in the City of Sunset
Hills in St. Louis County, Missouri, for the construction of
sanitary sewers to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by sewers; and
WHEREAS, sanitary sewers to serve such area must be
connected to a private system of sewers; and
WHEREAS, it has been estimated that the probable cost
of the installation of such sanitary sewers will be approximately
Forty-two Thousand Dollars ($42,000.00), and that a fee of Two
Hundred Seventy-five Dollars ($275.00) per lot or parcel of ground
served must be paid in addition, for connection of such sewers to
the private sewer system and that the most practicable method of
payment therefor is by special tax bills, or other evidence of
special benefit assessments upon the land which shall be found to
be benefitted by such improvement;
NOW, THEREFORE, BE IT RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 51 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing sanitary sewers in
the area of Deane Court in the City of Sunset Hills in St. Louis
County, Missouri, said subdistrict to be described as follows:
Beginning at the point of intersection of the east line of
Lindbergh, 100' wide Boulevard and the south line of Monica
Drive, 50' wide, said point being the northwest corner of Lot
6 in Block 3 of Sunset Manor Subdivision as recorded in Plat
Book 23 on Page 18 of the St. Louis County Records; thence
eastwardly along the south line of said Monica Drive a
distance of 135.0' to a point, said point also being the
northwest corner of Lot 7 of said Block 3; thence southwardly
along the west line of said Lot 7 a distance of 132.0' to the
southwest corner of said Lot 7; thence eastwardly along the
south line of Lot 7 and said line produced eastwardly to the
southeast corner of Lot 27 in Block 3 of Sunset Manor
Subdivision said corner being a point in the west line of
Lynwood Place, 40' wide; thence continuing eastwardly across
said Lynwood Place to the northwest corner of Lot 48 in Block
6 of said Sunset Manor Subdivision; thence eastwardly along
the north line of Lot 48 and said line produced eastwardly to
the northeast corner of Lot 39 of said Block 6; thence
southwardly along the east line of said Lot 39 a distance of
132.0' to the southeast corner of said Lot 39 said corner
being a point in the north line of Deane Court, 50' wide;
thence continuing southwardly across said Deane Court to the
northeast corner of Lot 10 in Block 5 of said Sunset Manor
Subdivision; thence continuing southwardly along the east
line of said Lot 10 to the southeast corner of said Lot 10
said corner being a point in a common line between Sunset
Manor Subdivision and the Hub Subdivision as recorded in Plat
Book 34 on Page 40 of the St. Louis County Records; thence
southwardly along the eastern line of said Lot 29 to the
southeast corner of said Lot 29; said corner being a point in
the north line of Watson Road, 100' wide, said Watson Road
being U. S. Highway 66; thence westwardly along the north
line of said Watson Road to its intersection with the
northward prolongation of the east line of a lot now or
formerly owned by Mall Tool Company as recorded in Deed Book
2993 on Page 292 of the St. Louis County Records; thence
southwardly along said prolongation across Watson Road and
along said lot line to its intersection with the north line
of Sturdy Estates Plat 3 Subdivision as recorded in Plat Book
79 on Page 17 of the St. Louis County Records; thence
westwardly along said line and said line produced westwardly
to the southwest corner of property now or formerly owned by
North A. and Mae Neely as recorded in Deed Book 2015, Page
550 of the St. Louis County Records; thence northwardly along
the west line of said Neely property and said line produced
northwardly across Watson Road to a point in the north line
of said Watson Road; thence westwardly along said north line
of Watson Road to its intersection with the east line of
Lindbergh Boulevard, 100' wide; thence northwardly along the
east line of said Lindbergh Boulevard to the point of
beginning.
Such sewers to be connected with a certain existing
private sewer owned by Russell & Company.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against each lot or parcel of ground which

is connected to said proposed sewers in payment of the fixed fee
for connection thereby to said private sewer system and that
additional special benefit assessments for the entire cost of such
sanitary sewers be levied against all land which shall be found to
be benefitted by the said construction in the proportion that the
area each such lot or parcel of land bears to the entire
benefitted area, exclusive of public streets, roads and alleys
within the said benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held within
said Special Benefit Subdistrict No. 51 at such time and place as
the Executive Director shall determine for the purpose of
determining whether or not it is in the public interest that such
improvement, or any part thereof, be made, and that notice of such
hearing be given by the posting of notices in not less than three
public places within the boundaries of the proposed special
benefit subdistrict.
