HomeMy Public PortalAboutR0176 R E S O L U T I O N NO. 176 WHEREAS, the Board has received a petition from property owners in the area of San Fernando Hills in the City of Florissant in St. Louis County, Missouri, for the construction of storm sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by storm sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such storm sewers will be approximately One Hundred Fifty-five Thousand Dollars ($155,000.00), and that the most practicable method of payment therefor is by special tax bills or other evidence of special benefit assessments upon the land which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 52 of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing storm sewers in the area of San Fernando Hills in the City of Florissant in St. Louis County, Missouri, said subdistrict to be described as follows: Beginning at a point, said point being the northeast corner of Lot 49 of West Duchesne Hills as recorded in Plat Book 63, Page 12 of the St. Louis County Records; thence southwardly along the east line of said West Duchesne Hills to a point, said point being the northwest corner of Lot 5 of Block 6 of Locust Spring Subdivision as recorded in Plat Book 68, Page 29 of the St. Louis County Records; thence southeastwardly in a straight line across said Lot 5 to the southeast corner of said Lot 5; thence eastwardly along the north line of West St. Anthony Lane, 50 feet wide to its intersection with the east line of Elm Drive; thence southwardly along the east line of Elm Drive to a point 30' north of the north line of Maple Drive; thence eastwardly along a line parallel to and 30' north of the north line of Maple Drive to its intersection with the northwest line of Lot 2 of Block 4 of Locust Spring Subdivision as recorded in Plat Book 55, Page 24; thence southwestwardly along said northwest line to the north line of Maple Drive, thence southwestwardly along the north line of said Maple Drive to its intersection with the centerline of Valley Drive; thence southwestwardly along the said centerline of Valley Drive to its intersection with the centerline of Elm Drive; thence southeastwardly along the centerline of said Elm Drive to its intersection with the westernmost line of Lot 24 of Block 2 of said Locust Spring Subdivision; thence southwardly along said westernmost line to the southwest corner of said Lot 24; thence eastwardly along the southernmost line of said Lot 24 a distance of 40' to a point; thence southwardly along a line parallel to and 40' from the easternmost line of Locust Drive to its intersection with the northernmost line of Lot 26 of said Block 2; thence eastwardly along said north line to the northeast corner of said Lot 26; thence southwardly along the east line of said Lot 26 to a point, said point being the northwest corner of Lot 13 of said Block 2; thence eastwardly along the north line of said Lot 13 a distance of 50'; thence southwardly along a line 50' from and parallel to the south west line of Lots 13, 12, 11 and 10 to a point 17.44' northwest of the southeast line of said Lot 10; thence southwestwardly parallel to and 17.44' northwest of the southeast line of said Lot 10 to its intersection with the southwest line of said Lot 10; thence southeastwardly along the southwest line of Lots 10, 9 and 8 to its intersection with the northeast corner of Lot 30 of said Block 2; thence southwestwardly in a straight line across said Lot 30 to the northernmost corner of Lot 9 in Block 1 of Maryville Subdivision as recorded in Plat Book 42, Page 48 of the St. Louis County Records; thence southwardly along the west line of Lots 9, 10, 12, 13 and 14 of said Block 1 to the southwest corner of said Lot 14; thence southwestwardly along a straight line to a point in the easternmost line of a lot now or formerly owned by the Catholic High School Association of the Archdiocese of the City of St. Louis, Missouri, as recorded in Deed Book 3572, Page 554 of the St. Louis County Records said point being 80' south of the northeast corner of the last mentioned lot, measured along said easternmost line; thence continuing southwardly along said easternmost line to its intersection with the western prolongation of the north line of Lot 1 of Block 3 of said Maryville Subdivision; thence eastwardly along said prolongation to the northwest corner of said Lot 1; thence southwardly along the west line of said Lot 1 and said line produced to its intersection with the centerline of U. S. Highway 66; thence westwardly along the centerline of U. S. Highway 66 to its intersection with the centerline of Lafayette Street; thence northwardly along the centerline of Lafayette Street to the centerline of Maple Drive; thence northeastwardly in a straight line to a point, said point being 30' east of the east line of Lafayette Street and 30' north of the north line of Maple Drive; thence northwardly along a line parallel to and 30' east of the east line of Lafayette Street a distance of 30' to a point; thence eastwardly along a line parallel to and 60' north of the north line of Maple Drive to its intersection with the west line of Lot 57 of San Fernando Hills #2 as recorded in Plat Book 57, Pages 8 and 9 of the St. Louis County Records; thence northwardly along said west line to the northwest corner of said Lot 57; thence eastwardly along the north line of said Lot 57 to the southwest corner of Lot 32 of said West Duchesne Hills Subdivision; thence northeastwardly along the west line of said Lot 32 and said line produced to its intersection with the centerline of St. Rose Court; thence northeastwardly along said centerline of said St. Rose Court to its intersection with the centerline of West St. Anthony Lane; thence northeastwardly in a straight line to the westernmost corner of Lot 95 of said West Duchesne Hills; thence northeastwardly along the northwest line of said Lot 95 a distance of 45'; thence eastwardly along a line parallel to and 45' north of the north line of West St. Anthony Lane to a point 45' west of the west line of St. Patrick Lane; thence southeastwardly in a straight line to the intersection of the centerline of West St. Anthony Lane and St. Patrick Lane; thence northeastwardly in a straight line to a point 31' east of the east line of St. Patrick Lane and 30' north of the north line of West St. Anthony Lane; thence northeastwardly in a straight line to a point 80' east of the east line of St. Patrick Lane and 60' north of the north line of West St. Anthony Lane; thence northwardly along a line parallel to and 80' east of the east line of St. Patrick Lane to its intersection with the northwest line of Lot 49 of said West Duchesne Hills Subdivision; thence northeastwardly and eastwardly along the northwest and north line of said Lot 49 to the point of beginning. Such sewers to be discharged into Fountain Creek, a tributary to Coldwater Creek. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all land which shall be found to be benefitted by the said construction in the proportion that the area each such parcel of land bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area; and BE IT FURTHER RESOLVED, that a public hearing be held 9 within said Special Benefit Subdistrict No. 52 at such time and place as the Executive Director shall determine for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed special benefit subdistrict. 10 The foregoing Resolution was adopted May 9, 1958.
